About modification and amendments in the Code of civil procedure of the Republic of Armenia

Article 1. Sections 3.1 and 3.2 of the Code of civil procedure of the Republic of Armenia of June 17, 1998 (further – the Code) to recognize invalid.

Article 2. Add the code with Section 3.3 in the following edition:

"Section 3.3. Legal proceedings of review of court resolution on again opened or new circumstances

Article 204.30. The court reviewing court resolution on again opened or new circumstances

1. Only the court resolution which took legal effect is subject to review on again opened or new circumstances.

2. The court resolution of Trial Court on again opened or new circumstances reviews Appeal Court, and court resolutions of appeal and cassation courts - court of cassation.

Article 204.31. Persons having the right to presentation of the claim for review of court resolution for again opened or new circumstances

Have the right to presentation of the claim for review of court resolution for again opened or new circumstances:

1) persons participating in case and their legal successors

2) persons who as of day of decision making of the Constitutional court about constitutionality of provision of the law had such right sales opportunity according to requirements (terms) of the Law of the Republic of Armenia "About the Constitutional court" or force of Items 3 or 5 of article 32 of this Law were deprived of possibility of consideration of the case in the Constitutional court,

3) persons who at the time of acceptance of the corresponding court resolution by the international court operating with participation of the Republic of Armenia had the right to appeal to the relevant international court, according to requirements (terms) of the international treaty.
