Article 1. To state Article 125 of the Code of civil procedure of the Republic of Armenia of June 17, 1998 (further – the Code) in the following edition:
"Article 125. The bases for the accelerated legal proceedings
1. The court applies the accelerated trial if:
1) the parties provided written consent about application of the accelerated legal proceedings on case or
2) the parties in writing notified court on the nonparticipation in legal proceedings, or
The court concludes 3) that:
a) need of his immediate trial proceeds from the main point,
b) about the facts on case which are subject to proof it is possible to make the conclusion based on research and estimation of proofs, available on case, and there is no dispute connected with the right
c) the claim is obviously reasonable,
d) the claim is obviously unreasonable.
2. The basis for application of the accelerated legal proceedings, in particular, are cases when:
1) the requirement is based on the indisputable right, with liquidated damages,
2) requirement of collection of the alimony which is not connected with recognition of paternity was imposed
3) requirement connected with employment dispute was imposed
4) the evidence confirming the requirement was not produced.
3. The court makes the decision on application of the accelerated legal proceedings.".
Article 2. To recognize article 126 of the Code invalid.
Article 3. To state article 127 of the Code in the following edition:
"Article 127. Phase-out of the accelerated legal proceedings
1. If during the accelerated legal proceedings the court comes to conclusion that there are no bases for application of the accelerated legal proceedings any more, then the court makes the decision on phase-out of the accelerated legal proceedings. In case of adoption of the similar decision, legal proceedings are performed in the procedure established by Chapter 18 of this Code.".
