About modification of the Code of civil procedure of the Republic of Armenia

Article 1. To state Item 1 of Article 204.33 of the Code of civil procedure of the Republic of Armenia of June 17, 1998 (further – the Code) in the following edition:

"1) the Constitutional court of the Republic of Armenia recognized the law provision applied by the court on this case contradicting the Constitution and invalid or recognized its corresponding to the Constitution, but in final part of the decision having revealed its constitutional and legal content, concluded that this provision was applied in other treatment.".

Article 2. To state article 204.38 of the Code in the following edition:

"Article 204.38. Rules of review of court resolution on again appeared and new circumstances

1. If this Section does not provide special rules, then general provisions of this Code extend to legal proceedings on review of court resolution on again appeared and new circumstances.

2. In the court resolution concluded as a result of these legal proceedings, the court can not change final part of the reviewed court resolution, only if is proved by specifying of powerful arguments that circumstances, stipulated in Article 204.32 or 204.33 of this Code, in fact, could not affect the outcome of the case.

3. The court resolution of Appeal Court in the general procedure established by the law can be appealed in Court of cassation.".

Article 3. This Law becomes effective for the tenth day after official publication.
