About modification and amendments in the Code of civil procedure of the Republic of Armenia

Article 1. To state Article 112 of the Code of civil procedure of the Republic of Armenia of June 17, 1998 (further – the Code) in the following edition:
"Article 112. Judicial session
1. Consideration of the case takes place by means of judicial sessions in the place which is specially provided for this purpose in court house (further – the hall of judicial sessions) about which persons participating in case and other participants of legal proceedings are surely notified.
2. The judgment judicial session can be exit if it proceeds from interests of efficiency of justice.".
Article 2. Add the Code with Article 112.1 of the following content:
"Article 112.1. Field judicial session
1. The court on own initiative or to the petition of person participating in case makes the decision on carrying out field judicial session.
2. The decision on carrying out field judicial session is made in the form of the separate act by which are established the place, time, circumstances which formed the basis for carrying out field judicial session, object of research in judicial session.
3. Field judicial session takes place according to the rules established by this Code for carrying out judicial session.".
Article 3. To state part 3 of Article 144 in the following edition:
"3. The decisions made on the questions requiring the solution during legal proceedings which is not subject to appeal according to the judicial discretion can be accepted in the form of separate acts or without registration in the form of the separate act. The decision, not properly executed in the form of the separate act, is published in oral form and joins in the minutes.".
Article 4. This Law becomes effective for the tenth day after official publication.
