About entering of amendments and changes into the Code of civil procedure of the Republic of Armenia

Article 1. To add part 1 of Article 42 of the Code of civil procedure of the Republic of Armenia of June 17, 1998 (further – the Code) with Item 3.1 of the following content:

"3. 1) participation in conciliatory process with the assistance of the certified conciliator.".

Article 2. To add Item 3 of part 1 of article 44.1 of the Code after the word "judges" with words ", arbitrators and conciliators".

Article 3. To add article 48 of the Code with Item 4.1 of the following content:

"4.1. Acceptance of any fact by person participating in case during conciliation, cannot be the basis for recognition of the fact confirmed.".

Article 4. To add part 1 of Article 103 with Item 3.1 of the following content:

"3. 1) one of the parties refers to the agreement on the dispute resolution by means of the conciliator, except for, if the court finds that this agreement is invalid, voided or cannot be obviously performed.".

Article 5. In article 109 of the Code:

Item 7 to state 1) in the following edition:

"7) the court confirmed the signed conciliation agreement, inclusive, the agreement of conciliation signed as a result of conciliatory procedures.".

To add 2) with Item 8 of the following content:

"8) as a result of conciliation of the party signed the conciliation agreement in which specified about suit abatement without approval of the conciliation agreement by court.".

Article 6. To add the second paragraph of article 120 of the Code with the new offer of the following content: "The chairman finds out also whether wish the party to resolve dispute with the help of conciliatory procedures, explaining essence of the conciliatory procedure.".

Article 7. In part 5 of article 132 of the Code:

1) word "claim". Item 7 to replace with the word "claim;",
