About modification of article 37 of the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons"

The Verkhovna Rada of Ukraine decides:

I. The text of article 37 of the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" (Sheets of the Verkhovna Rada of Ukraine, 1992, No. 29, Art. 399; 2006, No. No. 9-11, of Art. 96; 2007, No. 7-8, of Art. 66; 2008, 78) to state Art. No. No. 5-8, in the following edition:

"Pensions on the occasion of loss of the supporter which are granted to members of families of the military personnel of persons having pension entitlement under this Law cannot be lower than two sizes of subsistence minimum determined by the law for persons which lost working capacity".

II. Final provisions

1. This Law becomes effective since January 1, 2015.

2. Determine that persons who are earlier granted pension on the occasion of loss of the supporter according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" have the right to recalculation of pension taking into account provisions of this Law.

If as a result of recalculation on regulation of this Law the size of pension or the paid its part decreases, pension is paid in earlier established size.

3. In three-months time from the date of entry into force of this Law to provide to the Cabinet of Ministers of Ukraine carrying out recalculation of earlier granted pensions according to Item 2 of this Section.
