About modification and amendments in the Penitentiary code of the Republic of Armenia

Article 1. In Article 24 of the Penitentiary code of the Republic of Armenia (of December 24, 2004, further - the Code):

1) to exclude the words "as primary punishment" from part 1;

2) part 2 to recognize invalid.

Article 2. To exclude from part 4 of article 26 of the Code words "the pronouncing sentence".

Article 3. In article 32 of the Code:

1) to exclude the words "or local government body" from part 1;

Part 2 to state 2) in the following edition:

"2. Person condemned on execution of social jobs (further in this Chapter - the convict) shall be in division of execution of the punishments which are not connected with imprisonment within seven days after the introduction of the court verdict in legal force.

The convict is involved in social jobs, and the imposed penalty is performed within two years after the introduction of the court verdict in legal force. During execution of social jobs execution of the punishment can be interrupted for a period of up to one year no more than once.

The procedure and terms of attraction to social jobs establishes the Government of the Republic of Armenia.".

Article 4. To add article 33 of the Code with part 5 of the following content:

"5. In case of appeal of the convict on military or alternative service execution of the punishment in the form of social jobs is interrupted for the term of military or alternative service.".

Article 5. To state part 3 of article 35 of the Code in the following edition:

"3. It is malicious evading from serving sentence in the form of social jobs is recognized that convict who:

1) within a month executed social jobs less than ninety percent of the social jobs provided according to the accounting card of public working hours without reasonable excuse;

2) during execution of social jobs within one month more than two times roughly violated rules of labor discipline;
