About modification of some legal acts of Ukraine concerning expansion of powers of local government bodies and optimization of provision of administrative services

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Code of Ukraine about administrative offenses (The sheet of the Supreme Council of USSR, 1984, appendix to No. 51, the Art. 1122):

Article 197 to state 1) in the following edition:

"Article 197. Accommodation without passport of the citizen of Ukraine or without registration of the residence

Accommodation of the citizens obliged to have the passport of the citizen of Ukraine without passport of the citizen of Ukraine or according to the invalid passport of the citizen of Ukraine, and also accommodation of citizens without registration of the residence -

attract the prevention.

The same actions which are commited by person which within year was subjected to administrative punishment for the violations provided by part one of this Article -

involve imposing of penalty from one to three free minima of the income of citizens";

Article 199 to exclude 2);

Item 2 parts one of Article 213 to add 3) with the words "and their officials authorized on that by this Code";

"In Item 5" shall be replaced with words 4) in parts two of Article 217 of the word and figure also in figures "in Items 2, 5";

5) in Article 219:

add part one with figures "197, 198";

add with part two of the following content:

"On behalf of executive committees of village, settlement, city councils have the right to consider cases on the administrative offenses provided by Articles 197, of the 198th of this Code (when imposing administrative punishment in the form of the prevention in the center of provision of administrative services) administrators of the centers of provision of administrative services";

6) in part one of article 222-2 of figure "197-201" to replace with figures "200, 201";

7) in Article 255 part one:

add Item 2 with figures "197, 198";

add with Item 2-5 of the following content:

"2-5) officials authorized on that by local public administrations (Articles 197, 198)";

To add article 258 part one after figures "185-3" with words and figures "Article 197 (when imposing administrative punishment in the form of the prevention), Article 198 (when imposing administrative punishment in the form of the prevention)".

2. In Article 12 of the Land code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2002, Art. No. 3-4, 27):

to add the name after words of "city councils" with the words "and their executive bodies";

add with part two of the following content:

"In the field of land relations in the territory of villages, settlements, the cities treat powers of executive bodies of village, settlement, city councils:

1) provision of data from the State land cadastre according to the law;

2) the solution of other questions in the field of land relations according to the law".

3. In the Law of Ukraine "About procedure for departure from Ukraine and entry into Ukraine of citizens of Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 1994, No. 18, Art. 101 with subsequent changes):

1) in Article 6:

in part one:

in paragraph one of the word "in issue of the passport" shall be replaced with words "in trip abroad";

2, 6 and 8 to exclude Items;

in Item 5 of the word "the decision of other body (official)" to exclude;

the second to exclude part;

third to state part in the following edition:

"In case of the restrictions provided by this Article, the body which entered them notifies on them in ten-day time from the moment of their introduction:

1) the citizen of Ukraine concerning whom the corresponding restrictions are introduced;

2) bodies of the State Border Service of Ukraine which exercise control of observance of such restrictions";

And figure "Items 1, 2 and 6-8" to replace 2) in part two of Article 8 of the word with the word and figure "Item 1".

4. In the Law of Ukraine "About local self-government in Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 1997, No. 24, Art. 170 with subsequent changes):

The Item of part one of Article 33 to add 1) with the subitem 13 of the following content:

"13) provision of data from the State land cadastre according to the law";

To add 2) with Article 37-1 of the following content:

"Article 37-1. Powers in the field of registration of the residence of physical persons

1. The delegated powers belong to maintaining executive bodies of village, settlement, city councils:

1) forming and maintaining the register of territorial community according to the law";

Item 2 parts two of Article 38 to exclude 3).
