About introduction of amendments to the Law of Ukraine "About the measures directed to assistance of capitalization and restructuring of banks"

The Verkhovna Rada of Ukraine decides:

1. Bring in the Law of Ukraine "About the measures directed to assistance of capitalization and restructuring of banks" (Sheets of the Verkhovna Rada of Ukraine, 2015, No. 6, the Art. 41, No. 43, the Art. 386) the following changes:

Preamble to state 1) in the following edition:

"This Law is directed to protection of economic safety of the state, the rights, freedoms and legitimate interests of citizens, creation of conditions for ensuring stable activities of banks of Ukraine, strengthening of financial capability of bank system of Ukraine and minimization of negative impact of difficult economic situation, in particular, owing to temporary occupation of the territory Ukraine and conducting anti-terrorist operation";

2) in Article 8:

to state paragraph two of Item 1 in the following edition:

"This Law, except Items 5, of 6, of 9, 9-1 and 10 these Articles, is effective before acceptance by the Verkhovna Rada of Ukraine in connection with stabilization of financial and economic situation in Ukraine of the decision on loss of force, but not later than till January 1, 2017, except Item 9-1 of this Article which is effective till January 1, 2019";

add with Item 9-1 of the following content:

"9-1. The National Bank of Ukraine does not refer bank to category problem or insolvent on the bases determined in Item 1, paragraphs first, third item 4 and part one Item 4-1 of Article 75; Item 2 parts one of article 76 of the Law of Ukraine "About banks and banking activity", on condition of representation by bank to the National Bank of Ukraine of the program of the capitalization/restructuring plan, constituted, including, by results of diagnostic inspection, and also the actions plan on reduction of activities of bank in compliance with requirements of the legislation for transactions with the faces tied with bank and ensuring accomplishment of the specified programs/plans in the terms established in them".
