About providing sanitarno - epidemiological safety of the population

This Law establishes the legal, organizational, economic basis, measures connected with ensuring sanitary and epidemiologic safety of the population of the Republic of Tajikistan.

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

Sanitary and epidemiologic safety of the population - the state of health of the population and the habitat of the person in case of which there are no harmful effects of factors of the habitat per capita and are provided favorable conditions for its life activity;

The habitat of the person - set of objects, phenomena and factors surrounding (natural and artificial) environments, determining conditions of life activity of the person;

Habitat factors - biological (virus, bacterial, parasitic and others), chemical, physical (noise, vibration, ultrasound, infrasound, the thermal, ionizing, not ionizing and other radiations), social (food, water supply, conditions of life, work, rest) and other factors of the habitat which make or can make impact per capita and (or) on the state of health of future generations;

Harmful effects per capita - the impact of factors of the habitat creating threat of life or to health of the person or threat of life or to health of future generations;

Favorable conditions for life activity of the person - condition of the habitat in case of which there are no harmful effects of its factors per capita (harmless conditions) and are available opportunities for recovery of the broken functions of human body;

Safe conditions for the person - condition of the habitat in case of which there is no danger of harmful effects of its factors per capita;

Sanitary and epidemiologic situation the state of health of the population and the habitat in certain territory in specifically specified time;

The hygienic standard rate - the admissible maximum or minimum quantitative and (or) high-quality measure value established by researches, characterizing this or that factor of the habitat from line items on safety and (or) harmlessness for the person;

The state sanitary and epidemiologic rules and standard rates - the regulatory legal acts establishing sanitary and epidemiologic requirements (including criteria of safety and (or) harmlessness of factors of the habitat for the person, hygienic and other standard rates) which non-compliance creates threat of life or to health of the person, and also threat of origin and spread of diseases;

Socially - hygienic monitoring - the state system of observations of the state of health of the population and the habitat, their analysis, assessment and the forecast, and also determination of relationships of cause and effect between the state of health of the population and impact of factors of the habitat;

The state sanitary and epidemiological surveillance activities for the prevention, detection, suppression of violations of the law of the Republic of Tajikistan in the field of ensuring sanitary and epidemiologic safety of the population for the purpose of public health care and the habitat;

Sanitary and epidemiologic service - system of the bodies, organizations and organizations intended for sanitary and epidemiological surveillance implementation;

The sanitary and epidemiologic conclusion the document certifying compliance (discrepancy) to sanitary and hygienic rules of factors of the habitat, economic and other activity, products, works and services, and also drafts of regulations, construction projects of objects, operational documentation;

Sanitary and anti-epidemic (preventive) meropriyatiyaorganizatsionny, administrative, inzhenerno - the technical, medical and sanitary, veterinary and other measures directed to elimination or reduction of harmful effects per capita of factors of the habitat, prevention of origin and spread of infectious (parasitic) diseases and mass noninfectious diseases;

Quarantine (restrictive actions) the administrative, medical and sanitary, veterinary and other measures directed to prevention of spread of infectious diseases and providing specific mode of economic and other activity, restriction of movement of the population, vehicles, loads, goods and animals;

Infectious diseases - infectious diseases of the person which emergence and distribution is caused by impact per capita of biological factors of the habitat (causative agents of infectious diseases) and possibility of transfer of disease from the sick person and animal to the healthy person;

Mass noninfectious diseases (poisonings) - diseases of the person which emergence is caused by impact of physical and (or) chemical, and (or) social factors of the habitat;

Sanitary protection of the territory - complex of the actions directed to the prevention of drift and distribution of causative agents of quarantine and other infectious (parasitic) diseases in the territory of the country and performed by both boundary, and local healthcare institutions and sanitary and epidemiologic service;

Epidemiological inspection (inspection of the epidemic center) - the system of actions which is carried out in the epidemic center for the purpose of identification of the reasons and conditions of its origin and development of measures for its restriction and liquidation;

Epidemic - the category of intensity of epidemic process reflecting mass defeat of the population or its separate contingents infectious (parasitic) disease considerably exceeding the regular illness rate in this territory;

Epidemic flash (group disease) - short-term rise in incidence of infectious (parasitic) disease in limited national group (collective, the settlement) in which diseases are connected among themselves by general source of the activator or general way (factor) of its transfer;

Health - condition of complete physical, mental and social well-being, and not just absence of disease and physical defects;

Phytosanitary rules - set of the evidence-based regulating documents establishing requirements to condition of lands, the woods and vegetation, and also the number of wreckers of plants, spread of diseases of plants and to availability of weed plants;

Parasitic diseases - contamination condition protozoa or invazirovannost helminths in case of which infectious processes of any type develop;

The toxicology is the field of medical science studying patterns of interaction of live organism and poison;

Disinsection - extermination of arthropod ticks, being carriers of causative agents of infectious (parasitic) diseases, and also other insects having sanitary and hygienic value and preventing work and rest of people;

Deratization - extermination of rodents carriers of the infectious beginning, and also for the purpose of protection from them of harvest, food and property;

Disinfection - removal or destruction of causative agents of infectious (parasitic) diseases on environment objects;

- sanitary and epidemiologic examination - activities for establishment of compliance (discrepancy) of project and other documentation, objects of economic and other activity, products, works and services, state sanitarno - to epidemiological rules and standard rates.

Article 2. The legislation of the Republic of Tajikistan on providing sanitarno - epidemiological safety of the population

The legislation of the Republic of Tajikistan on providing sanitarno - epidemiological safety of the population is based on the Constitution of the Republic of Tajikistan, consists of this law, other regulatory legal acts of the Republic of Tajikistan and international legal acts recognized by Tajikistan.

Article 3. Providing sanitarno - epidemiological safety of the population

Sanitary epidemiological safety of the population is ensured:

prevention of diseases according to sanitarno epidemiological safety forecasting of their dynamics and its change;

development and implementation of the state, national and regional programs of providing sanitarno - epidemiological safety and strengthening of health of the population, prevention of diseases and improvement of the habitat of the person and conditions of its life activity;

accomplishment sanitarno - anti-epidemic (preventive) actions and obligatory respect by all physical persons and legal entities of sanitary standards and rules as component of the activities performed by them;

creation of economic interest of citizens, individual entrepreneurs and legal entities, foreign citizens and stateless persons in compliance with law in the field of sanitary and epidemiologic safety of the population, providing measures for attraction them to responsibility for sanitary offenses in the field of sanitary and epidemiologic safety of the population;

state sanitary and epidemiologic regulation;

state sanitary and epidemiological surveillance,

production and public control;

certification of products, the works and services constituting potential danger for life and health of the person;

issue of the sanitary and epidemiologic conclusion on types of activity, constituting potential danger for life, health of the person and state of environment;

state registration of chemical and biological substances, separate types of products, potentially dangerous to the person, according to the procedure established by the Government of the Republic of Tajikistan, the production wastes and consumption which are available, and also for the first time imported on the territory of the Republic of Tajikistan of separate types of products;

carrying out it is social - hygienic monitoring;

scientific research in the field of providing sanitarno epidemiological safety;

measures for timely informing the population on emergence of infectious diseases, mass noninfectious diseases (poisonings), condition of the habitat and the held sanitarnoprotivoepidemichesky (preventive) events;

measures for hygienic education and training of the population in promotion of healthy lifestyle;

- coordination of activities of other state bodies in the field of ensuring sanitary and epidemiologic safety of the population.
