About education

This Law, determining legal, organizational, social and economic basis of development of education in the Republic of Tajikistan, establishes structure of education system, the principles of its regulation, management, power and activity of its bodies and is the legal base for other regulatory legal acts of the Republic of Tajikistan in the field of education.

Chapter 1. General provisions

Article 1. Basic concepts

In this Law the following concepts are used:

education - purposeful training process and education for the benefit of the personality, society and the state in which the state fixes receipt of certain education level by the citizen;

education - receipt of certain education level by the citizen which makes sure the relevant document;

education system - set of educational programs and state educational standards, networks of the operating educational institutions, irrespective of forms of business and property, governing bodies of education, its organizations and the organizations, students and pupils, teachers and other employees, associations of the educational institutions, infrastructure divisions and other elements combined for the solution of the single purposes and tasks directed to realization of state policy in the fields of education, increase in contribution of this industry in social and economic development of the country and increase in welfare of the people;

the educational institution - the legal entity performing educational process that is realizes one or several educational programs and (or) provides education of students and pupils;

the special educational institution - the organization having special conditions of training and education, special educational climate and providing medical and social resettlement, training and professional training of the children and teenagers needing long treatment, having physical, mental variations or behavior of which is considered dangerous to society;

life-long education - possibility of training and advanced training throughout all human life;

remote education - the training process realization method based on use of the modern information and telecommunication technologies allowing to perform training at distance without direct personal contact between the teacher and the pupil;

individual occupation - the teacher's occupation with the student or the student with use of intensive methods of training;

literacy - ability to work with information, including ability to carry out necessary arithmetic transactions, perception of information from printed material, scientific literature, and also ability and writing skills for obtaining knowledge from oral and written texts;

the tutor - the teacher who trains students or students individually, off-duty hours at school or at university;

result of training - knowledge acquired by the student, abilities, skills, views, outlook and moral values for the period studies in educational institution;

form education - the procedure for the organization of education including day, evening, correspondence, family, remote forms of education and the external studies;

additional education - involvement of citizens to studying of modern science, the equipment and new technology, creativity, receipt of new specialty, retraining, enhancement of qualification and others which person can receive during study at school, after leaving school and receipt of the diploma;

the state accreditation - the procedure of determination of the status of educational institution for carrying out educational activities, according to the state educational standards;

certification - procedure for establishment of compliance of content, level and quality of training of graduates of educational institutions to requirements of the state educational standards;

the external studies - independent studying of disciplines of the main educational program with the subsequent final assessment in educational institution;

nostrification - determination of equivalence of documents of citizens which studied in the foreign states and the international organizations;

the educator - person who is engaged on professional basis in education and training of students including person of auxiliary service who directly joins in educational process;

the intern - the doctor taking qualification advanced training courses under the leadership of professor in internship;

internship - form of postdegree practice and enhancement of qualification of doctors in medical institution.

Article 2. Legislation of the Republic of Tajikistan on education

The legislation of the Republic of Tajikistan on education is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan and the international legal acts recognized by the Republic of Tajikistan.

Article 3. State policy in the field of education

The Republic of Tajikistan proclaims formation of one of priority industries.

The state for realization of educational policy creates education system of the Republic of Tajikistan, aims its activities at providing the rights of citizens to education.

Organizational basis of state policy in the field of education is the development program of education which is developed by the Government of the Republic of Tajikistan taking into account world achievements and is submited also approval of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan.

For the purpose of development of education coordination of activities of the ministries and committees, organizations and organizations, local authorities of the government, physical persons and legal entities is provided.

In governing bodies of education, in educational institutions, irrespective of forms of business and property, their associations (associations, the unions) creation and activities of organizational structures of political parties, social and political and religious movements is forbidden.

Article 4. The basic principles of state policy in the field of education

State policy in the field of education is based on the following principles:

priority of education at all levels of public administration;

obligation of general main education;

general availability of general secondary, primary professional education and obtaining according to capabilities and on competitive basis of the subsequent education levels;

humanistic nature of content of education, priority of national and universal values, free development of the personality;

respect of the law, rights and human freedom, love for the country, family and environment;

scientific, secular and humanistic nature of training and education in educational institutions;

unities of educational and cultural space, protection and development based on formation of national culture and cultural traditions;

democratic and state public nature of management of education;

autonomies of educational institutions;

continuity of education, the equal relation of the state to the state and non-state, including private educational institutions which form single system of formation of the Republic of Tajikistan;

education compliance to requirements and tasks of social and economic development of the Republic of Tajikistan;

tendencies of educational development taking into account international standards of quality of training and the international standards of information security of education.

Article 5. Legislation tasks in the field of education

The main objectives of the legislation in the field of education:

forming of the legal basis of guarantee of constitutional rights of citizens for education:

ensuring legal guarantees for activities and free development of educational institutions and coordination of their relations with other structures of public life;

establishment of powers, the rights, tasks and responsibility of state bodies of management, physical persons and legal entities in the fields of education, legal regulation of questions of its development and the relations of subjects of training process and education.
