About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. – Article 21-1 of the Law on domestic trade No. 231 of September 23, 2010 (2010, Art. No. 206-209, 681), with subsequent changes, to add the official monitor of the Republic of Moldova with part (4) the following content:
"(4) the Payment due date is established by the businessman of the perishable agrofood products provided by the signed agreement and delivered by the supplier in case of the conclusion of the agreement, but cannot exceed 30 calendar days from the date of delivery of goods by the supplier.".
Art. II. – In the Code of the Republic of Moldova about offenses No. 218-XVI of October 24, 2008 (Official monitor of the Republic of Moldova, 2009, Art. No. 3-6, 15), with subsequent changes, to make the following change and addition:
1. 5) of Article 273 to state Item in the following edition:
"5) violation of payment due dates of invoices in case of acquisition of perishable agrofood products, is attracted by imposing of penalty on the businessman in the amount of 50 to 100 conventional units in case of physical persons and in the amount of 200 to 400 conventional units in case of legal entities;".
2. Part (1) articles 402 after words "parts (1), (3) – (8) Articles 263," to add with words "part (5) Articles 273,".
Art. III. – (1) the execution which is in phase agreements which terms and conditions contradict provisions of this law are subject to corresponding change within 60 days from the date of entry into force of this law.
(2) For the purpose of check of the commercial relations between the businessman and the supplier representatives of the organizations subordinated to the Ministry of Finance can request all documents based on which these commercial relations are performed.
(3) This law becomes effective after 30 days from the date of publication.
