About modification and amendments in the Law of the Republic of Armenia "About legal profession"

Article 1. In article 42 of the Law of the Republic of Armenia "About legal profession" (of December 14, 2004, ZR-29-N, further - the Law):

Part 2 after the words "from the head of office" to add 1) with words ", two assistant administrators of office of the public defender";

To add 2) with part 3 following of content:

"The number of the lawyers working in office of the public defender establishes council of chamber of lawyers, within financing at the expense of means of the government budget.".

Article 2. To recognize part 5 of article 43 of the Law invalid.

Article 3. To state article 45 of the Law in the following edition:

"Article 45. Financing of office of the public defender, expense recovery connected with ensuring activities of the public defender

Financing of office of the public defender is performed at the expense of means of the government budget that shall provide normal activities of office of the public defender.

The President of Chamber of lawyers with the consent of the head of office of the public defender represents at the scheduled time to the government the preliminary estimate (the budget request) of expenses of office of the public defender, for inclusion in the draft of the government budget.

The budget request of office of the public defender, in case of acceptance by the government, joins in the draft of the government budget, and in case of objection together with the draft of the government budget it is submitted in National Assembly. The government represents reasons for objection of rather budget request to National Assembly and chamber of lawyers.

The financial resources allocated to office of the public defender cannot be spent in other purposes.

The office of the public defender can raise additional resources from the sources which are not prohibited by the Law which can be spent for improvement of activities of office, and also for cash encouragement for the purpose of effectiveness of activities of public defenders.
