About modification of some legal acts of Ukraine concerning strengthening of social protection of children and support of families with children
The Verkhovna Rada of Ukraine decides:
I. Make changes to the following legal acts of Ukraine:
1. Chapter 20 of the Family code of Ukraine (2002, 135) to state sheets of the Verkhovna Rada of Ukraine to Art. No. 21-22, in the following edition:
"Chapter 20 Patronage over the child
Article 252. Patronage over the child
1. Patronage over the child is temporary leaving, education and rehabilitation of the child in family of the foster tutor for overcoming by the child, his parents or other legal representatives of difficult vital circumstances.
2. The family of the foster tutor is family in which with the consent of all her members full age person who completed special course of training carries out obligations of the foster tutor on professional basis.
3. The foster tutor is person who with participation of family members renders services in leaving, education and rehabilitation of the child in the family.
4. Persons specified in article 212 of this Code cannot be the foster tutor.
5. In family of the foster tutor only children who are among themselves brothers and sisters, or children who were raised in one family can be at the same time arranged.
6. The term of stay of the child in family of the foster tutor is established by guardianship and custody body and cannot exceed three months.
In the presence of the circumstances proving need and feasibility of stay of the child in family of the foster tutor of more specified term, the guardianship and custody body can extend it.
Aggregate term of stay of the child in family of the foster tutor cannot exceed six months.
7. The procedure for creation and activities of family of the foster tutor, the device, stay of the child in family of the foster tutor affirms the Cabinet of Ministers of Ukraine.
The foster tutor is enlisted for work on the employment contract in budget institution of social protection of the population to destination according to local public administration or local council.
