About modification and amendments in the Law of Turkmenistan "About legal profession and lawyer activities in Turkmenistan"
I. Bring in the Law of Turkmenistan "About legal profession and lawyer activities in Turkmenistan", accepted on May 10, 2010 (Sheets of Majlis of Turkmenistan, 2010, No. 2, the Art. 29), the following changes and amendments:
1. In Article 6:
the fourth and fifth to state parts in the following edition:
"4. Payment for the legal aid given by lawyers is made on the basis of the agreement, except as specified, provided by part five, the seventh and eighth this Article.
5. In case of lack of the agreement on rendering the legal aid given by lawyers of legal advice bureau, payment for the legal aid given by the lawyer is established by the manager of legal advice bureau based on the Instruction about payment for the legal aid given by lawyers of the legal advice bureau approved by the Ministry адалат Turkmenistan in coordination with the Ministry of Finance of Turkmenistan.";
the seventh and eighth to state parts in the following edition:
"7. In cases of assignment of counsel of legal advice bureau in criminal trial of inquiry by body, the investigator, prosecutor, judge or court or in other cases if payment for the legal aid given by the lawyer is charged to the state, the size and procedure for this payment are determined by the bases provided by the criminal procedure legislation of Turkmenistan according to the Instruction about payment for the legal aid given by lawyers of legal advice bureau.
8. In case payment for the legal aid given by the lawyer is made at the expense of means of lawyer consolidation the size and procedure for this payment are determined according to the Instruction about payment for the legal aid given by lawyers of legal advice bureau.".
2. State Article 9 in the following edition:
"Article 9. Acquisition of the status of the lawyer
1. The status of the lawyer is acquired:
1) the person who obtained the license for rendering legal aid granted by the Ministry адалат Turkmenistan and entered in members of Bar of the welayat, city with the welayat rights;
