About modification of the Code of civil procedure of Ukraine concerning factual determination of the birth or the death of person in temporarily occupied territory of Ukraine

I. Bring in the Code of civil procedure of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2004, Art. No. No. 40-42, 492) the following changes:
1. Add with Article 257-1 of the following content:
"Article 257-1. Features of production on cases on factual determination of the birth or death of person in temporarily occupied territory of Ukraine
1. The statement for factual determination of the birth of person in temporarily occupied territory of Ukraine determined by the Verkhovna Rada of Ukraine can be submitted by parents, relatives, their representatives or other legal representatives of the child to any court outside this territory of Ukraine irrespective of the place of residence of the applicant.
The statement for factual determination of death of person in temporarily occupied territory of Ukraine determined by the Verkhovna Rada of Ukraine can be filed a lawsuit by relatives of the dead or their representatives outside this territory of Ukraine.
2. Cases on factual determination of the birth or the death of person in temporarily occupied territory of Ukraine determined by the Verkhovna Rada of Ukraine are considered instantly from the moment of receipt of the corresponding petition.
3. In the decision on factual determination of the birth of person in temporarily occupied territory of Ukraine determined by the Verkhovna Rada of Ukraine, in particular, persons this about birth date and birth place, about his parents shall be specified established by court.
4. The decision made by court on cases on factual determination of the birth or death of person in temporarily occupied territory of Ukraine determined by the Verkhovna Rada of Ukraine is subject to immediate execution.
The decision on cases on factual determination of the birth or death of person in temporarily occupied territory of Ukraine determined by the Verkhovna Rada of Ukraine can be appealed in the general procedure established by this Code. Appeal of the decision does not stop its execution.
