About introduction of amendments to the Criminal code of Ukraine concerning enhancement of protection of professional activity of journalists

The Verkhovna Rada of Ukraine decides:

1. Bring in the Criminal code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131) the following changes:

Part the second Article 163 to state 1) in the following edition:

"2. The same actions made repeatedly or concerning the state or public figures, the journalist, or made by the official or with use of the special means intended for secret removal of information -

are punished by imprisonment for a period of three up to seven years";

Article 171 to state 2) in the following edition:

"Article 171. Hindrance of legal professional activity of journalists

1. Unlawful taking of the materials collected, processed, prepared by the journalist and technical means which he uses in connection with the professional activity, illegal refusal in access for the journalist to information, illegal prohibition of illumination of separate subjects, display of individuals, criticism of the subject of powers of authority, and also any other intentional preventing to implementation by the journalist of legal professional activity -

are punished by penalty to fifty free minima of the income of citizens or arrest for a period of up to six months, or restriction of freedom for a period of up to three years.

2. Influence in any form on the journalist for the purpose of preventing to accomplishment of professional obligations by it or prosecution of the journalist in connection with its legal professional activity -

are punished by penalty to two hundred free minima of the income of citizens or arrest for a period of up to six months, or restriction of freedom for a period of up to four years.

3. The actions provided by part two of this Article if they are made by the official with use of the official position or by previous concert group of persons, -
