About modification and amendments in some legal acts

For the purpose of transposition of the Directive of Council 90/314/EES of June 13, 1990 about complex tourism, rest and complex tours, published in the Official magazine of the European Communities L 158 of June 23, 1990,

The Parliament adopts this organic law.

Art. I. – In the Civil code of the Republic of Moldova No. 1107-XV of June 6, 2002 (Official monitor of the Republic of Moldova, 2002, Art. No. 82-86, 661), with subsequent changes, to make the following changes and additions:

1. In part (Article 1131 the word "travel agent" shall be replaced with words 1) "the retail seller".

2. In Article 1132

part ("organizer" to add 1) after the word with the words "or retail seller";

add Article with part (1-1) following contents:

"(1-1) V of the preliminary information provided to the client shall be specified clearly, clear and precisely the price and the relevant information on the following:

a) the destination of travel, the used vehicles, their characteristics and category;

b) placement type, its location, category or level of comfort and the main characteristics, accreditation and tourist classification according to rules of the state of stay;

c) provision of food;

d) route;

e) applicable requirements concerning passports and visas, and also the sanitary procedures necessary for travel and stay;

f) the sum of money or percent from the price brought as deposit and term of introduction of other amount;

g) the fact that the service package requires the minimum number of persons, and in this case – deadline of informing the client in case of cancellation of packet;

h) conditions of advance booking.";

part (to state 2) in the following edition:

"(2) the Conditions specified in the advertisement, the offer or other information provided to the client are obligatory for the organizer or the retail seller, except for case when:

a) change of these conditions in clear form is brought to the attention the client to the conclusion of the agreement; in that case it shall be specified directly in the preliminary information;
