The government of the Republic of Kazakhstan and the Government of the Azerbaijan Republic, hereinafter referred to as "Parties",

proceeding from need of protection of the rights of citizens in the field of provision of pensions, understanding that the parties shall bear the direct responsibility for provision of pensions of the citizens,

Recognizing that the Parties have obligations concerning disabled persons which acquired the right to provision of pensions in the territory of one of the Parties and exercises this right to the territories of the Parties, Recognizing need of strict observance of obligations according to international agreements concerning provision of pensions,

agreed as follows:

Article 1

Provision of pensions of citizens of the Parties and members of their families is performed by the legislation of the state in the territory of which they live.

When moving the citizen the territory with which it leaves hereinafter is referred to as further as the Party of departure, and the territory in which he lives the Party of entrance.

Article 2

Provision of pensions of the military personnel of Armed Forces and Border troops of the Republic of Kazakhstan and the Azerbaijan Republic and members of their families, and also procedure for assignment for their provision of pensions, are regulated according to the procedure, determined by the relevant pension legislation of the Parties.

Article 3

All expenses connected with implementation of provision of pensions under this agreement are born by the Party representing providing. Mutual calculations are not made.

Article 4

This agreement extends to all types of provision of pensions of citizens which are established or will be established by the legislation of the Parties.

Article 5

1. Award of pension to citizens of the Parties is made at the place of residence.
