The Republic of Kazakhstan and the Republic of Uzbekistan which further are referred to as with High contracting parties

in the spirit of friendship and neighborliness, mutual respect and equality,

on the basis of the principles of respect of independence, sovereignty, territorial integrity, inviolability of borders of both states, non-interference to internal affairs of each other, mutual understanding and mutual trust,

for the purpose of refining and determination of passing of the line of Frontier between the Republic of Kazakhstan and the Republic of Uzbekistan (daleegosudarstvenny border),

according to provisions of the Contract on eternal friendship between the Republic of Kazakhstan and the Republic of Uzbekistan of October 31, 1998,

recognizing the inalienable right of all sovereign states to take necessary measures for proper protection of the frontiers,

confirming that High contracting parties have to each other no territorial claims,

in view of need of maintenance of the international legal mode on Frontier,

for the purpose of providing boundary, customs, sanitary and other necessary forms of control,

according to the commonly accepted rules of international law,

agreed as follows:

Article 1

High contracting parties determined passing of the line of Frontier on the basis of administrative-territorial differentiation between the Kazakh Soviet Socialist Republic and the Uzbek Soviet Socialist Republic.

Article 2

High contracting parties agreed that the line of Frontier between the Republic of Kazakhstan and the Republic of Uzbekistan passes in full accordance with the Description of passing of the line of Frontier between the Republic of Kazakhstan and the Republic of Uzbekistan, further - the Description (Appendix 1), being integral part of this Agreement.

Article 3

The line of Frontier is applied in red color on sheets of topographic maps of scale 1:100 000 and to kosmofotokart of scale 1:200 000 on the water area of the Aral Sea (Appendix 2). On sites of dense building and vigorous economic activity the line of Frontier is applied on sheets of topographic maps of scale 1:10 000 and 1:5 000 (Appendix 3). Both Appendices are integral parts of this Agreement.

Writing of the place own names used in texts of the Description in the Kazakh, Uzbek and Russian languages corresponds to the above-stated cards. All distances and coordinates mentioned in the Description are measured according to these cards.

Article 4

High contracting parties agreed about need of continuation of negotiations for permission of questions of passing of the line of Frontier between the Republic of Kazakhstan and the Republic of Uzbekistan from border point N 18 to border point N 19, from border point N 84 to border point N 85, from border point N 115 to border point N 117 and preparation of the relevant agreement.

Article 5

The point of joint of frontiers of the Republic of Kazakhstan, Turkmenistan and the Republic of Uzbekistan will be defined by the separate agreement between these states.

Article 6

Any natural changes which can happen in border strip including on the boundary rivers, do not involve changes in passing of the line of Frontier.

Article 7

High contracting parties agreed to create the Joint demarcation commission and to charge to this commission to perform demarcation of Frontier, and also to constitute detailed demarcation maps and to prepare draft documents by results of demarcation.

Article 8

High contracting parties will determine the Frontier mode in the separate agreement.

Article 9

All questions concerning interpretation or application of provisions of this agreement will solve High contracting parties by consultations and negotiations.

Article 10

This Agreement is termless and is not subject to denouncement. This Agreement is subject to ratification and becomes effective from the date of exchange of instruments of ratification.

It is made in the city of Astana on November 16, 2001 in duplicate in the Kazakh, Uzbek and Russian languages, and all texts are equally authoritative.

In case of disagreements in case of interpretation of provisions of this agreement, High contracting parties will address to the text in Russian.
