About entering of amendments into the Law of the Republic of Tajikistan "About finance lease (leasing)"

Article 1. Bring in the Law of the Republic of Tajikistan of April 22, 2003 "About finance lease (leasing)" (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2003, No. 4, the Art. 139) the following amendments:

1. Add Article 2 with paragraphs the third, fourth and fifth the following content:

"-finance lease (leasing) with further acquisition of property right regarding leasing - long-term type of finance lease (leasing) after which termination of term according to the agreement the subject of leasing can carry over the leasing recipient;

- operating finance lease (leasing) - type of finance lease (leasing) after which termination of term the subject of leasing does not carry over the leasing recipient and returns to the lessor;

- returnable finance lease (leasing) - type of finance lease (leasing) according to which the leasing recipient sells the property to the lessor on condition that the lessor will lease further this property to the leasing recipient;".

2. Add the law with Article 5 (1) the following content:

"Article 5 (1). Types of finance lease (leasing)

Types of finance lease (leasing):

- finance lease (leasing) with further acquisition of property right regarding leasing;

- operating finance lease (leasing);

- returnable finance lease (leasing).".

Article 2. Enact this Law after its official publication.
