The Republic of Kazakhstan and the Republic of Belarus which are hereinafter referred to as with the Parties for the purpose of further development of the relations between them,

recognizing need of settlement, the citizens of one state which is constantly living in the territory of other state connected with legal status

aiming for the benefit of the citizens at providing equal conditions of their accommodation in the territories of both Parties,

in view of provisions of the Convention on the legal assistance and legal relations on civil, family and criminal cases signed in the city of Minsk on January 22, 1993, confirming the obligations following from the conventional international documents on human rights which participants they are, agreed about the following:

Article 1

1. For the purposes of this Agreement the citizen of one Party is considered constantly living in the territory of other Party if he based on the permission issued by this other Party constantly lives in its territory and at the same time is not person who is constantly living in the territory of the Party of the nationality.

2. In this Agreement:

a) "The party of nationality" means the Party which citizen is the citizen of one Party who is constantly living in the territory of other Party;

b) "The party of accommodation" means the Party in the territory of which the citizen of other Party constantly lives.
