About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. – In the Code of road transport No. 150 of July 17, 2014 (The official monitor of the Republic of Moldova, 2014, Art. No. 247-248, 568) to make the following changes and additions:

1. In part (1) Article 5:

state the concept "bus" of the following edition:

"the bus – the road vehicle designed and equipped for transportation of passengers and used for this purpose, having more than 9 seats including driver's seat;";

state the concept "cabotage" of the following edition:

"cabotage – the motor transportation transportation of goods performed on paid basis by the foreign motor transportation operator or passengers between at least one place of loading/landing and one place of unloading/disembarkation, on circumstances, located in the territory of the Republic of Moldova. Movement of the road vehicle without load or passengers between two consecutive transactions on the international motor transportation carriages is not considered cabotage;";

in the concept "flight" changes concern only the text in state language;

after the concept "traffic schedule" to add part with the following concept:

"transit – the route established in the traffic schedule on which motor transportation transportation is performed;";

exclude the concept "unified plan of accounts and calculations";

"system of the integrated management – electronic management system procedure of motor transportation transportations according to the established technical requirements;

electronic system of weighing in movement – system of the measuring installations and devices which underwent checking which are established or built-in in carriageway in the places specified by the central industry body are connected online to the server of body, authorized to exercise control of observance of maximum permissible mass of road vehicles;";

after the concept "motor transportation transportation" to add part with the following concept:

"illegal motor transportation transportation – the transaction on motor transportation transportation performed by the physical person or legal entity which does not have the license for motor transportation transportations, or the person having the license for motor transportation transportations, but who did not get permission to motor transportation transportations of passengers along regular routes, valid for route at which works, or the irregular motor transportation transportation of passengers performed in absence on circumstances, books of INTERBUS, permission to not liberalized irregular motor transportation transportations, the control list. Implementation of taxi motor transportation transportation of passengers along the routes established by the taxi driver which go out of the settlement in which the company is registered is also considered illegal motor transportation transportation;";

state the concept "irregular motor transportation transportation of passengers" of the following edition:

"irregular motor transportation transportation of passengers – the service in motor transportation transportation other than motor transportation transportation of passengers in regular routes and motor transportation transportation of passengers along special regular routes performed based on the agreement and which is characterized generally by what provides transportation of groups of the passengers constituted previously at the initiative of the client or the motor transportation operator;".

2. In Item c) parts (Article 7 of the word "issues in five-day imprisonment term on the changes made to district programs of motor transportation transportations" shall be replaced with words 2) "issues in 20-day imprisonment term on the offered changes in district programs of motor transportation transportations".

3. In part (2) Article 9:

Item j) to declare invalid;
