About modification of the Water code of the Republic of Armenia

Article 1. Article 8 of the Water code of the Republic of Armenia of June 4, 2002 (further - the Code) to add with Item 3 following of content:
"3) is issued by the conclusion:
- about issue of permissions to water use for the purpose of construction of small hydroelectric power stations in the territories which do not have the plan of basin management
- about issue of permissions to water use by term from 5 to 15 years for the purpose of operation of small hydroelectric power stations in the territories which do not have the plan of basin management.".
Article 2. To state part 3 of article 33 of the Code in the following edition:
"Effective period of permission to water use in the territories which do not have the plan of basin management cannot be more than 5 years, except for the permissions to water use provided to small hydroelectric power stations for the purpose of operation.
Permissions to water use for the purpose of construction of small hydroelectric power stations in the territories which do not have the plan of basin management are issued in case of the positive conclusion of National council of water of the Republic of Armenia.
In case of the positive conclusion of National council of water of permission to water use for the purpose of construction of small hydroelectric power stations in the territories which do not have the plan of basin management are issued for a period of 5 years, and for the purpose of operation of small hydroelectric power stations – for up to 15 years.".
The procedure for issue of permissions to water use establishes the Government of the Republic of Armenia.
Article 3. This Law becomes effective for the tenth day following behind day of official publication.
