The Ministry of Defence of the Republic of Kazakhstan and the Ministry of Defence of Ukraine which are hereinafter referred to as with the Parties

based on provisions of the Treaty of friendship and cooperation between the Republic of Kazakhstan and Ukraine of January 20, 1994,

expressing the mutual aspiration to develop cooperation in the field of military education,

agreed as follows:

Article 1

The parties provide possibility of preparation and enhancement (further preparation) the military personnel in military educational institutions, on rates (further military educational institutions) both Parties, receipt of academic degrees, carrying out research works as groups of contractual number and in the scientific directions.

On the basis of the requests which arrived till February first of year of the beginning of training, authorized representatives of the Parties sign the plan of preparation of military personnel which determines the name of military educational institutions and special preparation, terms of training and the number of the servicemen directed to training. The parties, according to the mutual arrangement, have opportunity to submit additional applications for training of the military personnel.

In case of non-arrival of the military personnel of one Party in military educational institutions of other Party within 15 days after the stipulated starting date of training they lose the right to such training. If the host party will be warned about impossibility of arrival of the military personnel less than in 3 months prior to training, the sending party pays to the host party penalty in the amount of 50% of training cost in month. The exception is constituted by cases of non-arrival of the military personnel for the reasons which are not depending on the sending party, or the serviceman directed to training.
