Article 1

Withdrawals, stipulated in Article 1 Agreements between the Government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic on free trade of June 22, 1995, extend on:

1. The goods falling under operation of the legislation of the Republic of Kazakhstan on export procedure and the commodity import functioning at the time of customs clearance of goods, in particular on:

- goods which export is performed based on registration of contracts;

- goods which export and import is performed according to licenses based on permission of the Cabinet of Ministers of the Republic of Kazakhstan;

- strategically important resources;

- goods which import is performed according to licenses.

2. The goods falling under operations of the Kyrgyz legislation on export rate and also legislations on licensing and quoting of the commodity export (works, services) operating at the time of carrying out customs clearance of goods in case of their export from the Kyrgyz Republic to the Republic of Kazakhstan.

Article 2

1. Withdrawals from free trade regime according to Article of 1 this Protocol, extend to the goods falling under operations of the Kazakhstan legislation on export rate. The parties also provide regime of the favored nation about that, as for:

- the taxes and fees levied when exporting including methods of collection of such taxes and fees;

- the provisions concerning customs clearance of transit, transportation, warehousing, overload and other similar services;

- payment methods and payment transfer;

- issues of export certificates and certificates;

- the rules concerning sale, purchase, transportation, distribution and use of goods in the domestic market.

2. Provisions of Item 1 of this Article are not applied to:
