About modification and amendments in the order of the Minister of health and social development of the Republic of Kazakhstan of April 28, 2015 No. 279 "About approval of standards of the state services in the social and labor sphere"

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:  

1. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of April 28, 2015 No. 279 "About approval of standards of the state services in the social and labor sphere" (registered in the Register of state registration of regulatory legal acts for No. 11342, published in information system of law of Ad_let on July 10, 2015) the following changes and amendments:

1) in the Standard of the state service "Issue of Information on Receipt and Movement of Means of the Investor of the Single Accumulation Pension Fund" approved by the specified order:

state Item 9 in the following edition:

"9. Uslugopoluchatel for rendering the state service provides the statement in form according to appendix 1 to this standard of the state service and the following documents:

in case of the personal address:

1) the identity document of uslugopoluchatel (it is required for identification of the personality);

in case of the address of the confided person:

1) the identity document of uslugopoluchatel (it is required for identification of the personality);

2) the power of attorney certified notarially – in case of representation of interests of the receiver of the state service by the third party;

in case of the address of heirs:

1) the will – for persons specified in the will;

2) heritable case, copies of the death certificate – for notaries and foreign consular establishments;

in case of the appeal of courts:

1) for courts - determination on the cases which are in their production.

Provision of the will for courts is not required.

Receives data of the identity document of uslugopoluchatel of TsON specified in the electronic statement from the corresponding state information system through lock of "the electronic government".

On the portal:

request in electronic form, certified by the digital signature (further - the EDS) uslugopoluchatel.";

2) in the Standard of the state service "Purpose of the Public Social Benefits on Disability, on the occasion of Loss of the Supporter and on Age" approved by the specified order:

state Item 3 in the following edition:

"3. The state service appears territorial subdivisions of Committee of work, social protection and migration of the Ministry (further – the service provider).

Reception of an application on rendering the state service is performed through:

1) the Republican state company on the right of economic maintaining "Service center of the population" of Committee on communication, informatization and information of the Ministry for Investments and Development of the Republic of Kazakhstan (further – TsON);

2) the Republican state state company "State Center for Pension Payment of the Ministry of Health and Social Development of the Republic of Kazakhstan" (further – GTsVP);

3) the web portal of "the electronic government" www.egov.kz (further – the portal) – in case of purpose of the public social benefit on age, and also in case of receipt of information on purpose of the public social benefits on disability, on the occasion of loss of the supporter and on age (further – benefits);

4) the service provider – in case of primary establishment of disability behind purpose of the public social benefit on disability.

Issue of result of rendering the state service is performed through:

1) TsON – in case of the request for purpose of benefits through TsON;

2) GTsVP – in case of the request for purpose of benefits through GTsVP or the service provider;

3) the portal – in case of the request for purpose of the public social benefits on age through the portal and regarding receipt of information on purpose of benefits.";

"4. Term of rendering the state service:

1) in case of the address to the service provider, in TsON, GTsVP, and also on the portal (for purpose of the public social benefit on age) – from the moment of registration of document package in GTsVP - 8 (eight) working days.

Term of rendering the state service:

it is prolonged in cases of need of dooformleniye of case papers as required for check of reliability of the provided document(s) or reclamation of the additional document(s) – for the term of 30 (thirty) working days, at the same time, if documents are completed, the state service is rendered – 8 (eight) working days from the date of provision of the additional document(s) in GTsVP. GTsVP notifies the applicant on need of submission of additional documents – 5 (five) working days;

on the portal for receipt of information on purpose of benefits – 30 minutes from the moment of receipt of electronic request in information system GTsVP;

in case of the address to the service provider and into TsON – day of acceptance is not included rendering the state service in time;

2) the most allowed time of expectation for delivery of document package in GTsVP – 30 minutes, in TsON – 15 minutes; from the service provider – time for expectation is not required;

3) the most allowed time of servicing of uslugopoluchatel in GTsVP and the service provider has 30 minutes, in TsON – 20 minutes.";

state Item 8 in the following edition:

"8. Working schedule:

1) GTsVP – Monday through Friday inclusive from 9:00 till 18:00 o'clock, with lunch break from 13:00 till 14:00 o'clock, except days off and holidays according to the Labor code of the Republic of Kazakhstan.

Reception of an application and issue of result of rendering the state service is performed: Monday through Saturday inclusive from 9:00 till 14:00 o'clock.

The state service is rendered in turn, without making an appointment and the accelerated servicing;

2) TsONa – Monday through Saturday inclusive, in compliance the working schedule from 9:00 to 20:00 o'clock without interruption for lunch, except days off and holidays, according to the Labor code of the Republic of Kazakhstan.

The state service is rendered in place of registration of uslugopoluchatel, according to the procedure of "electronic queue", without the accelerated servicing, "booking" of electronic queue by means of the portal is possible;

3) the portal – round the clock, except for the technical breaks connected with carrying out repair work.

In case of the request of uslugopoluchatel for purpose of the public social benefit on age after the termination of working hours, in days off and holidays according to the Labor code of the Republic of Kazakhstan, reception of an application and issue of result of rendering the state service is performed the next working afternoon;

4) the service provider – Monday through Friday inclusive from 9:00 till 18:30 o'clock, with lunch break from 13:00 till 14:30 o'clock, except days off and holidays according to the Labor code of the Republic of Kazakhstan.

The schedule of reception of an application on rendering the state service: from 9:00 to 17:30 o'clock with lunch break from 13:00 to 14:30 o'clock.

The state service is rendered without making an appointment and the accelerated servicing.";

state Item 9 in the following edition:

"9. Uslugopoluchatel (or his representative under the notarized power of attorney) for rendering the state service in case of the address to GTsVP or to TsON provides the statement in form according to appendix 1, in case of the address to the service provider provides the statement in form according to appendix 1-1 to this standard of the state service and the following documents:

For purpose of the public social benefit on disability:

1) the identity document (the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan, the certificate of the stateless person, the residence permit of the foreigner, the certificate of the oralman before receipt of nationality of the Republic of Kazakhstan) (it is required for identification of the personality);

2) the document confirming registration on the permanent residence of uslugopoluchatel (the address reference or the reference of rural akims, for residents Baikonur – the reference of department of accounting and registration of citizens of housing of the city of Baikonur of the Russian Federation);

3) the document on bank account number in banks of the second level, the organizations having licenses of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivisions of Kazpochta joint-stock company or about the control account of cash of correctional facility;

4) the certificate of disability in the form approved by the order of the Minister of health and social development of the Republic of Kazakhstan of January 30, 2015 No. 44 "About approval of Rules of conducting medico-social examination" (it is registered in the Register of state registration of regulations for No. 10589);

If necessary (depending on availability) one of the following documents is submitted:

1) the decision of Interdepartmental advisory council on establishment of causal relationship of diseases, disability of persons which underwent to radiative effects;

2) decision of the Central military-medical commission;

3) the certificate on disease granted by hospital or the conclusion of the military-medical commission;

4) the certificate of birth of the handicapped child up to sixteen years (the statement from the birth record or the certificate of registration of the act of civil status, issued by bodies of civil registration);

5) the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage (in case of change of surname of the parent/guardian).

In case of establishment of guardianship (guardianship), the document confirming establishment of guardianship (guardianship) is submitted.

For purpose of the public social benefit on the occasion of loss of the supporter:

1) the identity document (the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan, the certificate of the stateless person, the residence permit of the foreigner, the certificate of the oralman before receipt of nationality of the Republic of Kazakhstan) (it is required for identification of the personality);

2) the document confirming registration on the permanent residence of uslugopoluchatel (the address reference or the reference of rural akims, for residents Baikonur the reference of department of accounting and registration of citizens of housing of the city of Baikonur of the Russian Federation);

3) the document on bank account number in banks of the second level, the organizations having licenses of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivisions of Kazpochta joint-stock company or about the control account of cash of correctional facility;

4) the death certificate of the supporter or the judgment about recognition of person is unknown absent (dead);

5) the document confirming the related relations of the dependent with the dead (the certificate of birth, about scrap, about annulment of marriage, about paternity proof (motherhood) and others).

Depending on their availability the following documents are submitted:

1) the reference of bodies of civil registration (if data on the father in the certificate of birth are entered according to the statement of mother);

2) the reference of educational institution in the form approved by the order No. 223, if dependents aged from eighteen up to twenty three years are students of full-time courses (it is provided annually);

3) document on establishment of guardianship or custody;

4) the military ID of the died (dead) or the certificate of passing of military service;

5) the document on death or the death of the serviceman, employee of law-enforcement bodies and the former State Investigative Committee of the Republic of Kazakhstan owing to wound, contusions, mutilations, diseases got on duty or passing of military service.

In case of purpose of the public basic social benefit on the occasion of loss of the supporter by person occupied with care of the children, brothers, sisters or grandsons of the died supporter who did not reach eight years annually uslugopoluchately the service record with record about the termination of labor activity is submitted, in case of its absence GTsVP is requested from information systems of the data that person is not registered as the individual entrepreneur and from the automated information system GTsVP about lack of the fact of transfer of compulsory pension contributions.

For purpose of the public social benefit on age:

1) the identity document (the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan, the certificate of the stateless person, the residence permit of the foreigner, the certificate of the oralman before receipt of nationality of the Republic of Kazakhstan) (it is required for identification of the personality);

2) the document confirming registration on the permanent residence of uslugopoluchatel (the address reference or the reference of rural akims, for inhabitants Baikonur – the reference of department of accounting and registration of citizens of housing Baikonur of the Russian Federation);

3) the document on bank account number in banks of the second level, the organizations having licenses of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivisions of Kazpochta joint-stock company or about the control account of cash of correctional facility.

In case of establishment of guardianship (guardianship), the document confirming establishment of guardianship (guardianship) is submitted;

Submission of the identity document of uslugopoluchatel, the document confirming registration on the permanent residence, certificates of birth of the handicapped child up to sixteen years (on the registration made in the territory of the Republic of Kazakhstan after August 13, 2007), the document on establishment of guardianship (guardianship), the reference of body of state revenues that person is not registered as the individual entrepreneur of the certificate of disability is not required in case of confirmation of information containing in the specified documents, the state information systems.

for purpose of the public social benefit on age – the statement on purpose of the public social benefit on age through the portal in electronic form certified by the EDS of uslugopoluchatel according to appendix 2 to this standard of the state service;

for receipt of information on purpose of benefits – request in electronic form, the uslugopoluchatel certified by the EDS.

Data of the identity document of uslugopoluchatel, the document confirming registration on the permanent residence of uslugopoluchatel, data on bank account number, the document on establishment of guardianship (guardianship) for purpose of the public social benefit on age specified in the electronic statement uslugopoluchatel receives from the corresponding state information systems through lock of "the electronic government".

The worker of GTsVP, TsONa, the service provider receives the written consent of uslugopoluchatel to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.

When giving by uslugopoluchatel of all required documents to uslugopoluchatel it is issued:

in GTsVP, the service provider has detachable coupon of the statement with indication of registration date and the date of receipt of the state service, surname and initials of person who accepted documents;

in TsONe – the receipt on acceptance of the relevant documents with indication of:

1) statements with indication of number and date of reception of an application;

2) type of required state service;

3) quantity and the name of the enclosed documents;

4) date (time) and place of issue of documents;

5) surnames, name, middle name (in case of its availability) the employee of the center which adopted the statement on document creation;

6) surnames, name, middle name (in case of its availability) uslugopoluchatel, surname, name, middle name (in case of its availability) the representative of uslugopoluchatel and their contact telephone numbers;

through the portal – in "personal account" of uslugopoluchatel the status about acceptance of request for rendering the state service is displayed.

The result of rendering the state service is issued in case of presentation of the document of the uslugopoluchatel proving the identity in case of personal visit (or his representative under the notarized power of attorney):

in GTsVP – based on the detachable coupon of the statement;

in TsONe – based on the receipt on acceptance of the relevant documents.

GTsVP informs uslugopoluchatel on the made decision by means of transfer of the SMS notification on the mobile phone of uslugopoluchatel.";

state Item 10 in the following edition:

"10. In case of provision the uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 these standards of the state service, the worker of TsONa issues the receipt on refusal in documents acceptance in form according to appendix 3 or the worker of GTsVP or the service provider issue the notification on refusal in reception of an application on award of pension and benefits in form according to appendix 4 to this standard of the state service.

In case of receipt of the data from information system GTsVP confirming the fact of purpose of the corresponding payment or filing of application to purpose of benefits, the worker of GTsVP, TsONa, the service provider the notification on refusal in reception of an application in form according to appendix 5 to this standard of the state service is issued.";

"14-1. The state service by the service provider is rendered:

1) in the location of division of medico-social examination of the service provider (departments of medico-social examination and (or) departments of methodology and control of medico-social examination) of the respective region;

2) at field meetings:

based on treatment and prevention facilities at the permanent address (registration) of uslugopoluchatel;

in the location on treatment in specialized agencies;

in correctional facilities and pre-trial detention centers, in the place of stay of uslugopoluchatel;

at home, in hospital – if person for health reasons according to the conclusion of the medical and advisory commission cannot be for medico-social examination;

3) in absentia – when osvidetelstvuyemy person is nontransportable and (or) is on hospitalization outside the serviced region, based on the submitted documents determined by Item 9 of the Standard of the state service "Establishment of Disability and/or Extent of Disability and/or Determination of Necessary Measures of Social Protection" from consent about the witnessed person or the legal representative.";

3) Standard of the state service "Purpose of social payment to cases of social risks: disabilities; losses of the supporter; work losses; losses of the income in connection with pregnancy and childbirth; losses of the income in connection with adoption (adoption) of newborn child(children); of age of one year on reaching it" to be reworded as follows losses of the income in connection with child care according to appendix 4 to this order;

4) in the Standard of the state service "Purpose of Benefits for the Birth of the Child and on Child Care" approved by the specified order:

1) in case of the address to TsON, GTsVP, on the portal – from the moment of registration of document package in GTsVP – 7 (seven) working days;

Term of rendering the state service:
