About introduction of amendments to the Tax Code of Ukraine concerning release from the taxation of pensions

The Verkhovna Rada of Ukraine decides:

I. Bring in the Tax code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2011, Art. No. No. 13-17, 112) the following changes:

1.  To state subitem 164.2.19 of Item 164.2 of Article 164 in the following edition:

"164.2.19. Pension amounts (including the amount of their indexation added according to the law) or monthly perpetual monetary pay, received by the taxpayer from the Pension fund of Ukraine or the budget according to the law if their size exceeds ten sizes of subsistence minimum for persons which lost working capacity (per month), the accounting tax year established for January 1, - regarding such exceeding, and also pensions from foreign sources if according to international treaties which consent to be bound is provided by the Verkhovna Rada of Ukraine such pensions are subject to the taxation or tax are not assessed in the country of their payment.

Provisions of this subitem it is not applied to the pensions granted to combatants, disabled veterans and persons on whom operation of article 10 of the Law of Ukraine "On the status of veterans of war, guarantees of their social protection" expatiates.

2. In Item 167.4 of article 167 of figure "15" to replace with figures "18".

II. Final provisions

1. This Law becomes effective from the first following after month of its publication.

2. To the Cabinet of Ministers of Ukraine in a month from the date of entry into force of this Law:

bring the regulatory legal acts into accord with this Law;

provide reduction by the ministries, other central executive bodies of their regulatory legal acts in compliance with this Law.
