About introduction of amendments to the order of the Ministry of Justice of Ukraine of November 11, 2015 No. 2268/5

According to the subitem 74 Items 4, order to Item 10 of the Regulations on the Ministry of Justice of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 2, 2014 No. 228, and for the purpose of enhancement of the procedure of putting down of apostille on the official documents issued by judicial authorities and courts and also on documents which are processed by notaries of Ukraine:

1. In Item 6 of the order of the Ministry of Justice of Ukraine of November 11, 2015 to No. 2268/5 "About streamlining of the relations on putting down of apostille and preparation of documents for their consular legalization", the word registered in the Ministry of Justice of Ukraine on November 11, 2015 for No. 1419/27864," including to provide production and delivery of justice by the head territorial administration in areas and the city of Kiev of brands of apostille for their further use of the Ministry of Justice of Ukraine by territorial authorities" to exclude.

2. Bring in the Procedure for putting down of apostille on the official documents issued by judicial authorities and courts and also on documents which are processed by notaries of Ukraine, No. 2268/5, approved by the order of the Ministry of Justice of Ukraine of November 11, 2015 registered in the Ministry of Justice of Ukraine on November 11, 2015 for No. 1419/27864 (further - the Procedure), the following changes:

1) in the Section IV:

state Item 2 in the following edition:

"2. The official of territorial authority of the Ministry of Justice of Ukraine according to Rules visualizes on paper the apostille created by means of software of maintaining the Register in electronic form with obligatory putting down in Item 9 of stamp of apostille of seal which sample and the description are determined in appendix 3 to the Procedure, or attachment in this Item of brand of apostille which sample and the description are determined in appendix 4 to the Procedure.

If visualization of the apostille created by means of software of maintaining the Register in electronic form is performed on the single sheet, the place of fastening of the document and leaf with apostille is certified by the signature of the official of territorial authority of the Ministry of Justice of Ukraine and the seal specified in this Item or on this place the apostille brand is attached.";

in paragraph three of item 4 of the word "repeated submission of the statement by the applicant and" to exclude;

2) in appendices:

1, 2 to state appendices in editions which are applied;

in mark to appendix 3 to replace figure "3" with figure "4".

With respect thereto to consider appendix 3 respectively appendix 4;

add the Procedure with new appendix 3, which is applied;

in appendix 4 words" that corresponds to numbering of department of state registration of acts of civil status of territorial authorities of the Ministry of Justice of Ukraine" to exclude.

3. Determine that:

the remaining balance of brands of apostille which is available as of June 20, 2016 in territorial authorities of the Ministry of Justice of Ukraine in areas till June 30, 2016 is subject to transfer of justice to the Head territorial administration in the city of Kiev for their further use only by departments of state registration of acts of civil status of the city of Kiev;

about transfer of remaining balance of brands of apostille the statement in triplicate in which are specified date, the place of its creation, quantity of the transferred brands of apostille which is sealed by official and is signed by heads of departments which performed acceptance transfer of brands of apostille is drawn up. One copy of the act goes to the Ministry of Justice of Ukraine, second and third remain in departments of state registration of acts of civil status of managements of state registration of the head territorial administrations of justice which made acceptance transfer of brands of apostille;

use of seal which sample and the description are determined in appendix 3 to the Procedure by officials of departments of state registration of acts of civil status of territorial authorities of the Ministry of Justice of Ukraine in areas is performed since June 20, 2016, officials of departments of state registration of acts of civil status of territorial authority of the Ministry of Justice of Ukraine in Kiev - after complete use of brands of apostille.

4. And in the city of Kiev to provide to chiefs of the head territorial administrations of justice in areas:

acceptance transfer of remaining balance of brands of apostille by departments of state registration of acts of civil status of managements of state registration in department of state registration of acts of civil status of Management of state registration of the Head territorial administration of justice in the city of Kiev;

production of seals according to the sample and the description determined in appendix 3 to the Procedure;

proper execution of Item 5 of this order, and also control of storage and use of the seals used by territorial authorities of the Ministry of Justice of Ukraine.

5. To provide to the chief of the Head territorial administration of justice in the city of Kiev storage and use of brands of apostille with observance of requirements of the current legislation.

6. To department of state registration and notariate, to chiefs of the head territorial administrations of justice in areas and the city of Kiev to provide proper accomplishment of this order.

7. To the administrator of the Electronic register of apostilles to take the adequate measures necessary for implementation of this order.

8. To department of private law to submit this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

9. This order becomes effective from the date of its official publication.

10. To impose control over the implementation of this order on the first deputy Minister Sevostyanova N. I.
