About determination of market value of securities
According to Item 13 of article 8 of the Law of Ukraine "About state regulation of the security market in Ukraine", to the paragraph to the second Item 2 parts two of article 8 of the Law of Ukraine "About joint-stock companies", for the purpose of establishment of procedure for determination of market value of securities the National commission on securities and the stock market SOLVED:
1. Determine that if securities address on two and more stock exchanges and their average stock exchange rate for the last three months of the address preceding day as of which market value of securities is determined at the different exchanges differs, market value of such securities is determined by the supervisory board (if creation of the supervisory board is not provided by charter of joint-stock company - executive body of society) as arithmetic-mean value of the stock exchange rates of such securities calculated by stock exchanges according to the regulatory legal act of the National commission on the securities and the stock market establishing procedure for determination of the stock exchange rate of security within the last three months of their address preceding day as of which market value of such securities is determined.
If securities address on two and more stock exchanges and at the same time within the last three months of their address preceding day as of which market value of such securities is determined on one of stock exchanges the stock exchange rate of these securities was not calculated, market value of such securities is determined by the supervisory board (if creation of the supervisory board is not provided by charter of joint-stock company - executive body of society) as the cost of securities as of this date determined according to the legislation on assessment of property, property rights and professional estimative activity.
