About introduction of amendments to some laws of Ukraine concerning elimination of regulatory barriers to development of public-private partnership and stimulation of investments into Ukraine

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following laws of Ukraine:

1. "About lease of the state-owned and utility property" (Sheets of the Verkhovna Rada of Ukraine, 1995, No. 5, Art. 99 with subsequent changes) to add article 1 of the Law of Ukraine with part ten of the following content:

"10. The relations of the use of the private partner of the state-owned, utility property and property belonging to the Autonomous Republic of Crimea, created or acquired by this private partner in agreement performance, concluded within public-private partnership after transition of the property right to such property to the state, territorial community or the Autonomous Republic of Crimea are regulated by the Law of Ukraine "About public-private partnership".

2. In the Law of Ukraine "About concessions" (Sheets of the Verkhovna Rada of Ukraine, 1999, No. 41, Art. 372 with subsequent changes):

1) in Article 3:

the eighteenth to state the paragraph to part two in the following edition:

"Use of subjects to welfare appointment";

the sixth to state part in the following edition:

"6. In case of arrangement of subject to concession on the parcel of land of the state-owned or utility property which powers according to the order are performed by the concessor such parcel of land is provided in lease to the concessionary together with subject to concession on effective period of the concession treaty according to the Land code of Ukraine and the Law of Ukraine "About lease of land". The property right to the corresponding parcel of land is performed by the concessor according to the law. Regarding transfer to the concessionary of the right to concession asset construction the concession treaty becomes effective from the date of acquisition of right to use of the parcels of land provided in accordance with the established procedure to the concessionary for concession asset construction";
