About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. – In the Law on National Bank of Moldova No. 548-XIII of July 21, 1995 (repeated publication: The official monitor of the Republic of Moldova, 2015, Art. No. 297-300, 544), with subsequent changes to make the following changes and additions:

1. Part (Article 5 to add 1) with Item n) the following content:

"n) establishes Single central depositary, performs, regulates and controls its activities according to the functions established by the law on Single central depositary and other regulations.".

2. Add Article 6 with part (5) the following content:

"(5) Without prejudice to part provisions (Article 11 and Article 11-1, any body of the public power or any third party cannot approve, stop, cancel, subject 4) to censorship, detain or cause entry into force of acts of National Bank, express opinions of ex-ante on acts of National Bank or any otherwise to influence the edition National Bank of the final act.".

3. Add Article 11 with parts (3-2) and (3-3) following of content:

"(3-2) Regulations published by National Bank are not subject to legal examination of the Ministry of Justice. After approval the National Bank represents the regulations to the Ministry of Justice for registration in the State register of legal acts. The term of registration does not exceed three working days.

(3-3) Regulations published by National Bank fall under action of provisions of the Law on transparency of decision making process No. 239-XVI of November 13, 2008. In the course of consultations with concerned parties concerning development of the regulations the National Bank requests opinion of advisory nature from the Ministry of Justice.".
