About introduction of amendments to the Constitution of Ukraine (concerning justice)

The Verkhovna Rada of Ukraine decides:

I. Bring in the Constitution of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 1996, No. 30, the Art. 141) the following changes:

Article 124 - 129, 130, 131, 147 - 148, 149, 151, 153 to state 1) in the following edition:

"Article 124. JUSTICE IN UKRAINE is PERFORMED ONLY by COURTS.

Delegation of functions of courts, and also assignment of these functions by other bodies or officials are not allowed.

Jurisdiction of courts extends to any jurisdictional dispute and any criminal charge. In the cases provided by the law courts consider also another matters.

The obligatory pre-judicial procedure for dispute settlement can be determined by the law.

The people directly take part in implementation of justice through jurors.

Ukraine can recognize jurisdiction of the International Criminal Court on the conditions determined by the Rome Statute of the International Criminal Court.

Article 125. The JUDICIAL SYSTEM IN UKRAINE is BASED ON the PRINCIPLES of TERRITORIALITY AND SPECIALIZATION AND is DETERMINED by the LAW.

The court will be formed, will be reorganized and liquidated by the law which draft is introduced to the Verkhovna Rada of Ukraine by the President of Ukraine after consultations with the Supreme council of justice.

The Supreme Court is the supreme court in system of judicial system of Ukraine.

According to the law the supreme specialized courts can be effective.

For the purpose of protection of the rights, freedoms and interests of person in the field of the public relations administrative courts are effective.

Creation of emergency and special courts is not allowed.

Article 126. INDEPENDENCE AND IMMUNITY of JUDGES are GUARANTEED by the CONSTITUTION AND the LAWS of UKRAINE.

Influence on the judge by any method is forbidden.

Without the consent of the Supreme council of justice the judge cannot be detained or be held in custody or arrest before removal of conviction by court, except for detentions of the judge in time or at once after making of heavy or especially serious crime.
