About modification of article 13 of the Law of Ukraine "About features of implementation of the property right in the apartment house"

I. Item 5 of article 13 of the Law of Ukraine "About features of implementation of the property right in the apartment house" (2015, 29, the Art. 262) to state sheets of the Verkhovna Rada of Ukraine to No. in the following edition:

"5. If within one year from the date of entry into force of this Law co-owners of the apartment house in which associations of co-owners are not created did not make the decision on the form of government the apartment house, control of such house is exercised of the managing director who is appointed on competitive basis by executive body of local council in the territory of which the apartment house is located. If the local council or its executive body according to the legislation makes the decision on delegation to other body to the subject of powers of authority of functions on implementation of management of objects of housing and communal services, ensuring their content and effective operation, necessary level and quality the managing director is appointed on competitive basis by such body.

In that case the price of service in management of the apartment house is determined by results of competition which is held according to the procedure, established by the central executive body providing forming of the state housing policies and policy in the field of housing and communal services, and the service provision agreement on management of the apartment house for a period of one year on behalf of co-owners signs the authorized person of executive body of the relevant local council according to which solution the managing director is appointed. If in one month prior to the expiration of the specified term any of the parties does not notify in writing other party on refusal of the agreement, the agreement is considered extended for the next one-year term.
