About approval of the Provision on the technical supervision exercised by the National inspectorate of public safety

For the purpose of safety of traffic, increase in efficiency of technical supervision, determination of forms of relations with the Government of the Republic of Moldova DECIDES: physical persons and legal entities

1. Approve the Provision on the technical supervision exercised by the National inspectorate of public safety it (is applied).

2. To the ministries, departments and bodies of local public authority to take adequate measures on acquaintance of the economic agents who are engaged in production, operation, repair, maintenance and testing of vehicles, and also drivers with requirements of the specified provision.

Provision on the technical supervision exercised by the National inspectorate of public safety

I. General provisions

1. The provision on the technical supervision exercised by the National inspectorate of public safety (further - the Provision), is directed to streamlining and ensuring efficiency of technical supervision, establishes duties of all divisions of the National inspectorate of public safety which are responsible for technical supervision and procedure for their accomplishment, determines forms of relations with legal entities and physical persons - owners of automotor-vehicles and trail cars to them (in dalneyshemtransportny means), the economic agents who are engaged in production, operation, maintenance, repair and technical testing of vehicles and also with driver's structure.

2. The main task of the technical supervision exercised by the National inspectorate of public safety is traffic safety.

Activities of the employees of the National inspectorate of public safety responsible for technical supervision are directed to accomplishment of measures for traffic safety prevention, the prevention of the road accidents and decrease in their weight and are based on the principles of legality, humanity, social justice, openness. In case of accomplishment of obligations they are guided by the Constitution of the Republic of Moldova, the Law on police, other laws of the Republic of Moldova, decrees and orders of the President of the Republic of Moldova, resolutions of Parliament and Government of the Republic of Moldova, departmental documents of the Ministry of Internal Affairs, other regulating documents, international treaties which party the Republic of Moldova is, and this provision.

4. The national inspectorate of public safety performs the activities for technical supervision in interaction with other services of law-enforcement bodies, the ministries and departments, other organizations which activities are connected with safety of traffic and environmental protection.

5. Technical supervision concerning the vehicles which are in the territory of the Republic of Moldova belonging to diplomatic and consular representations, and also other foreign missions accredited in the Republic of Moldova and to their employees who according to the current legislation use immunity is performed according to the procedure, established by the Ministry of Internal Affairs in coordination with the Ministry of Foreign Affairs and European Integration and other interested organizations, on the principle of reciprocity accepted in relations of the Republic of Moldova with other states.

6. Employees of the National inspectorate of public safety bear the responsibility for failure to carry out of the obligations assigned to them established by the current legislation and misuse of the rights granted to them.

II. Distribution of obligations on technical supervision between divisions of the National inspectorate of public safety

7. The national inspectorate of public safety performs functions of the state control and management, and also other service duties on technical supervision according to the existing regulations.

8. Services of the National inspectorate of public safety of commissariats of police carry out the following obligations on technical supervision:

in interaction with nature protection bodies will organize and perform periodic state technical inspections of vehicles;

control carrying out by the companies, organizations and organizations - owners of vehicles - actions for content of vehicles in good repair and holding nature protection actions by them;

in interaction with bodies of environmental protection exercise control of compliance of technical condition of vehicles and their equipment to requirements of Traffic regulations, the existing standards and other regulations relating to safety of traffic and environmental protection;

exercise control of quality of repair, maintenance and testing of the vehicles which are carried out by licensed economic agents in the part relating to traffic safety.

III. Participation in development of rules, standard rates and standards on safety of traffic and environmental protection

9. Management of the National inspectorate of public safety in accordance with the established procedure participates in development of rules, standard rates and standards.

10. The list of documents which are developed by the National inspectorate of public safety or with its participation includes the rules, standard rates and standards establishing:

the nomenclature of components of design of the vehicles and additional devices influencing traffic safety;
