About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. – In the Criminal code of the Republic of Moldova No. 985-XV of April 18, 2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes to make the following changes and additions:

1. In part (Article 54 of the word "can be applied" to replace 2) with the word "are applied".

2. State Article 93 in the following edition:

"Article 93. Release from punishment of minors

The minors condemned for making of insignificant crime, crime of average weight or serious crime are exempted from punishment by degree of jurisdiction if it is determined that the goals of punishment can be achieved by application of enforcement powers of educational nature, stipulated in Article 104.".

3. In Article 104:

in part (1):

in the prolog of the word "can be applied" to replace with the word "are applied", and after words "Article 54" to add part with the words "or from criminal penalty according to Article 93";

in Item d) "medical" to exclude the word;

Item e) to state in the following edition:

"e) assignment on the minor of obligation on passing of rate of compulsory education;";

add part with Item f) the following content:

"f) assignment on the minor of obligation on participation in the probatsionny program.";

part (to state 4) in the following edition:

"(4) in case of systematic evasion of the minor from enforcement powers of educational nature the prosecutor according to the offer of specialized state body cancels the applied measures and directs case to degree of jurisdiction, and in case of establishment of these measures by degree of jurisdiction the last cancels them and decides about transfer of criminal case to the prosecutor or, on circumstances, establishes the punishment prescribed by the law for committed act.";
