About modification and amendments in the Code of penal procedure of the Republic of Moldova No. 122-XV of March 14, 2003
The Parliament adopts this organic law.
In the Code of penal procedure of the Republic of Moldova No. 122-XV of March 14, 2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes to make the following changes and additions:
1. Part (Article 1 to add 3) with the words "or did not fall victim of violation of other basic rights.
2. Add Article 6 with Items 4-3) and 25-1) of the following content:
"4-3) reasonable suspicion – the assumption following from availability of the facts and/or information capable to convince the objective observer that it is made or prepare crime execution, charged to certain person (certain persons) and that there are no other facts and/or information which eliminate criminal nature of act or prove non-participation of person (persons);";
25-1) bench warrant – the official court document which offers or allowed carrying out actions for criminal prosecution, special search events, application of measures of procedural coercion or carrying out other legal proceedings and which contains the order, its reasons and powers of the person, the acting on the basis of the this order;".
3. In Article 11:
part (to add 3) after the words "special educational facility" with words ", and also prolongation of these measures";
part (to add 6) after words "Criminal prosecution authority" with the word", the prosecutor".
4. In part (1) Article 18 of the word "this Article." shall be replaced with words "this code.".
5. In part (3) Article 20 of the word "suspects, persons accused or defendants are subjected to provisional attachment", shall be replaced with words "persons are under arrest,".
6. Add Article 40 with part (4) the following content:
