About introduction of amendments to the order of the Minister of Finance of the Republic of Kazakhstan of April 27, 2015 No. 284 "About approval of standards of the state services rendered by bodies of state revenues of the Republic of Kazakhstan"

I ORDER:

1. Bring in the order of the Minister of Finance of the Republic of Kazakhstan of April 27, 2015 No. 284 "About approval of standards of the state services rendered by bodies of state revenues of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts at No. 11273, it is published in information system of law of Ad_let on June 25, 2015) the following changes:

in the standard of the state service "Registration Accounting of the Individual Entrepreneur" approved by the specified order:

2) of Item 3 to state the subitem in the following edition:

"2) through non-commercial joint-stock company "The Governments for Citizens State Corporation (Further — the State Corporation);";

state item 4 in the following edition:

"4. Terms of rendering the state service from the moment of delivery of document package to the service provider:

1) statement of uslugopoluchatel on registration accounting as the individual entrepreneur (further - SP) - within 1 (one) working day from the moment of representation by uslugopoluchatel of documents;

In case of the appeal to the State corporation day of acceptance does not enter rendering the state service in time.

change of the registration data specified in the certificate of SP, replacement of the certificate of SP and (or) data on participants (members) of joint individual venture specified in the tax statement - within 1 (one) working day following behind day of receipt of documents; removal of uslugopoluchatel from registration accounting as SP on condition of lack of the unexecuted tax liabilities - no later than 3 (three) working days.

3) the most allowed time of servicing of uslugopoluchatel by the service provider - 20 (twenty) minutes, in the State corporation - 15 (fifteen) minutes.";

the fourth Item 6 to state part in the following edition:

"In case of the address of uslugopoluchatel to the service provider or in the State corporation on paper, the result of rendering the state service certified by the EDS of the official of the service provider is unpacked, and issued to uslugopoluchatel on paper.";

state Item 7 in the following edition:

"7. The state service is rendered on free basis to physical persons (further - uslugopoluchatel).";

2) of Item 8 to state the subitem in the following edition:

"2) the State corporation - Monday through Saturday, except for Sundays, holidays according to the labor law of the Republic of Kazakhstan according to the established working schedule from 9:00 to 20:00 o'clock, without interruption for lunch.

Acceptance is performed according to the procedure of electronic queue, in place of registration of uslugopoluchatel without the accelerated servicing, possibly booking of electronic queue by means of the portal;";

state Item 9 in the following edition:

"9. The list of the documents necessary for rendering the state service in case of the address of uslugopoluchatel of physical persons - citizens of the Republic of Kazakhstan, oralmans, citizens of the Republic of Belarus, the Kyrgyz Republic and the Republic of Tajikistan having the status of the permanent resident in the Republic of Kazakhstan:

to the service provider or in the State corporation:

1) for registration as SP and change of registration data:

the tax statement in form according to appendix 1 to this standard of the state service;

the copy of the identity document (the original for identification of the identity of uslugopoluchatel);

the document confirming the property right to real estate and uses to them or the address reference; the consent of legal representatives, and in the absence of such consent - the copy of the certificate on marriage (matrimony) or the copy of the decision of guardianship and custody body or the copy of the judgment about the announcement of the minor sui juris - in case of the address of the uslugopoluchatel who did not reach full age age;

2) for removal from registration accounting: The SP within a month from the date of decision making about the activities termination at the same time represents to tax authority in the place of the stay:

the tax statement according to appendix 2 and (or) 3 to this standard of the state service;

liquidating tax statements;

the tax statement for removal from registration VAT accounting - in case of the termination of activities of the SP which is the payer of the VAT;

the certificate on statement on registration accounting on the value added tax (further - the VAT) or the explanation on paper in case of its loss or spoil - in case of the termination of activities of the SP which is the payer of the VAT;

the tax statement for removal from registration accounting on separate types of activity in the presence of such accounting;

the tax statement for removal from accounting of cash register (further - KKM) in the presence of KKM.

Documents for registration as SP in the form of personal entrepreneurship are submitted by personally physical person, registered as SP, in the form of joint individual venture move person, the representative to represent the interests in the relations with the third parties and state bodies.

In case of registration as SP of the physical person which did not reach full age age, the tax application is submitted in attendance procedure on paper.

In case of the address to the service provider the uslugopoluchatel receives the coupon with mark about acceptance of document package, with indication of date and time of acceptance of document package.

In the State corporation issue of ready documents is performed based on the receipt on acceptance of the relevant documents, in case of presentation of the identity document.

In case of documents acceptance the service provider, the State corporation verifies copies with originals of documents then returns originals to uslugopoluchatel.

In case of receipt of the state service through the State corporation, the uslugopoluchatel gives the written consent to use of the data which are the secret protected by the law, containing in information systems in the form provided by the State corporation if other is not provided by the laws of the Republic of Kazakhstan.

The state corporation provides storage of result within one month then transfers them to the service provider for further storage. In case of the address of uslugopoluchatel after one month, at the request of the State corporation the service provider within one working day sends ready documents to the State corporation for issue to uslugopoluchatel;

on the portal for registration as SP and change of registration data:

the tax statement in electronic form, according to appendix 1 to this standard of the state service;

In case of the address through the portal to uslugopoluchatel the status about acceptance of request for rendering the state service with indication of date and time of receipt of result of the state service goes.";

the second Item 10 to state part in the following edition: "In case of the appeal to the State corporation, in case of provision by uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 these standards of the state service, the employee of the State corporation refuses reception of an application and issues the receipt on refusal in documents acceptance in form according to appendix 6 to this standard of the state service.";

to state heading of Chapter 3 in the following edition:

"3. Procedure for appeal of decisions, actions (failure to act) of the central state body, and also service providers and (or) their officials, the State corporation and (or) their workers concerning rendering the state services";

the second and sixth Item 11 to state parts in the following edition:

"The claim to actions (failure to act) of the employee of the State corporation is sent to the head of the State corporation to the addresses and phones specified on Internet resource of the State corporation: www.con.gov.kz.";

"The claim of uslugopoluchatel concerning rendering the state services which arrived to the Ministry, the service provider, the State corporation is subject to consideration within five working days from the date of its registration.";

14. Addresses of places of rendering the state service are placed on Internet resources of the service provider of www.kgd.gov.kz, the Ministry of www.minfin.gov.kz, the www.con.gov.kz State corporation.";

1) statement of uslugopoluchatel - the citizen of the Republic of Kazakhstan on registration accounting as the lawyer, the private notary, the private legal executive, professional mediator - within 1 (one) working day from the date of giving through the portal of documents.

In case of the appeal to the State corporation day of acceptance does not enter rendering the state service in time;

2) change of data on the location of the private notary, the private legal executive, the lawyer, professional mediator - within 1 (one) working day following behind day of giving through the portal of documents;

3) removal of uslugopoluchatel from registration accounting as the private notary, the private legal executive, the lawyer, professional mediator on condition of lack of the unexecuted tax liabilities - no later than 3 (three) working days from the date of submission of documents to the service provider or in the State corporation;

4) the most allowed time of expectation for delivery of document package uslugopoluchatel to the service provider - 20 (twenty) minutes, in the State corporation - 15 (fifteen) minutes;

5) the most allowed time of servicing of uslugopoluchatel by the service provider - 20 (twenty) minutes, in the State corporation - 15 (fifteen) minutes.";

2) of Item 8 to state the subitem in the following edition:

"2) the State corporation - Monday through Saturday, except for Sundays, holidays according to the labor law of the Republic of Kazakhstan according to the established working schedule from 9:00 to 20:00 o'clock, without interruption for lunch.

Acceptance is performed according to the procedure of electronic queue, in place of registration of uslugopoluchatel without the accelerated servicing, possibly booking of electronic queue by means of the portal;";

3) notarially attested copy of the decision of general meeting of participants (shareholders) of the legal entity or one member (shareholder) of the legal entity consisting of one participant (shareholder) - for modification and (or) amendments of registration data of uslugopoluchatel on the head of the legal entity in GBD of NP;

4) notarially attested copy of the decision of authorized body of the legal entity on appointment of the head of the structural unit of the legal entity or other document confirming it powers - for modification and (or) amendments of registration data of uslugopoluchatel on the head of the structural unit of the legal entity in GBD of NP;

5) liquidating tax statements in connection with liquidation of legal resident person of the Republic of Kazakhstan, their branches, representations, reorganization of the legal entity, the termination of activities of structural division of legal nonresident person, the legal nonresident person performing activities in the territory of the Republic of Kazakhstan without opening of branch, representation;

6) the certificate on statement on registration accounting on the value added tax or the explanation on paper in case of its loss or spoil, in connection with liquidation, reorganization of legal resident person of the Republic of Kazakhstan, the termination of activities of structural division of legal nonresident person - the taxpayer on value added;

7) the liquidation balance sheet in connection with liquidation, reorganization of legal resident person of the Republic of Kazakhstan, the termination of activities of structural division of legal nonresident person - after completion of documentary check and debt repayment before the budget;

8) the separation balance sheet, in connection with reorganization of legal resident person of the Republic of Kazakhstan by separation after completion of documentary check;

9) the copy of the decision of legal resident person of the Republic of Kazakhstan on the termination of activities of structural division in connection with the termination of activities structural division of legal resident person of the Republic of Kazakhstan;

10) the tax statement for removal from accounting of cash register in connection with liquidation of legal resident person of the Republic of Kazakhstan in the simplified procedure;

11) the transfer act by reorganization of legal resident person of the Republic of Kazakhstan by merge, accession, allocation.
