About implementation by resident borrowers of separate payments on repayment of external debt on the credits, foreign currency loans

According to Articles 7, of 15, of 30, 44 Laws of Ukraine "About the National Bank of Ukraine" and for the purpose of assistance of restructuring of external debt under agreements (agreements) which provide accomplishment by resident borrowers of debt obligations before nonresidents on the credits/foreign currency loans attracted from nonresidents on the terms of subordinated debt and/or on credits/foreign currency loans, financed by the means received from placement of debt securities outside Ukraine (further - the Credit agreement), the Board of the National Bank of Ukraine decides:

1. In case of prolongation of repayment period of principal debt according to the Credit agreement the resident borrower has the right to once perform for benefit of the nonresident creditor the payment of the additional commission caused by implementation of such prolongation according to the credit agreement (taking into account its prolongation) without such payment in case of control of observance of the maximum interest rate established by the National Bank of Ukraine for external borrowings of residents / for attraction of subordinated debt in case of simultaneous observance of the following conditions:

1) the repayment period of principal debt according to the Credit agreement is prolonged for two years at least;

2) the size of such additional commission does not exceed 2% of the main amount of debt according to the credit agreement which is prolonged;
