About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. – In the Law on penal system No. 1036-XIII of December 17, 1996 (repeated publication: The official monitor of the Republic of Moldova, 2008, Art. No. 183-185, 654), with subsequent changes to make the following changes:
1. To state the name of Chapter VI in the following edition:
"Chapter VI. Legal protection of employees of penal system, their material, social and medical support"
2. State Article 30 in the following edition:
"Article 30. Social and medical support of employees of penal system and members of their families
(1) the Maternity leave, including the spouse of the employee of the penal system which is at it in dependence, partially paid leave on child care before achievement of age by it three years, carer's leave for the sick child aged up to 10 years and child care leave with oncological disease or the child with limited opportunities in case of the diseases which are not connected with restriction of opportunities aged up to 18 years are provided in accordance with general practice.
(2) the Basis for calculation and the size of the benefits provided for the period stays on the leaves provided by part (1), are determined according to the procedure and in accordance with the terms, provided by the Law on temporary disability benefits and other benefits of social insurance No. 289-XV of July 22, 2004, by analogy to insured persons.
(3) the Benefits provided for the period stays on the leaves provided by part (1), are paid on place of employment of the employee of penal system from the government budget.
(4) Provision of pensions of employees of penal system is performed according to the procedure, the established Law on provision of pensions of the military personnel and persons of the commanding and ordinary structure of law-enforcement bodies No. 1544-XII of June 23, 1993, considering the privileges established by parts (2) and (3) article 33 of this law.
(5) Pensions to employees of penal system are established by pension body of Department of penal institutions.
