About introduction of amendments to some acts of the Government of the Russian Federation concerning enhancement of procedure for pricing in the territories united in not price zones of the wholesale market of electrical energy and capacity

List of amending documents

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning enhancement of procedure for pricing in the territories united in not price zones of the wholesale market of electrical energy and capacity.

2. To Federal Antimonopoly Service in coordination with the Ministry of Energy of the Russian Federation to bring till June 1, 2016 in the regulatory legal acts of change according to this resolution, having provided the introduction them in force since July 1, 2016.

3. To executive bodies of subjects of the Russian Federation in the field of state regulation of rates to accept till June 15, 2016 decisions on establishment (about review) according to this resolution in the territories united in not price zones of the wholesale market of electrical energy and capacity:

the prices (rates) for electrical energy (capacity) delivered in the retail markets in the territories not united in price zones of the wholesale market (except for electrical energy (capacity) delivered to the population and categories of consumers equated to it), in the form of formulas;

the prices (rates) for electrical energy (capacity) developed by electric power producers (capacity) in the retail markets including rate for 1 kilowatt hour of electrical energy and rate for 1 kilowatt of size of capacity;

weighted average cost of unit of electrical energy (capacity) acquired by the guaranteeing supplier in the retail markets of electrical energy at regulated prices (rates).

To executive bodies of subjects of the Russian Federation in the field of state regulation of rates to provide the introduction of the specified decisions in force since July 1, 2016.

4. To provide to the Ministry of Energy of the Russian Federation in coordination with the Ministry of Economic Development of the Russian Federation and Federal Antimonopoly Service till December 1, 2016 to the Government of the Russian Federation offers on modification of regulatory legal acts regarding procedure of payments the organization of commercial infrastructure of the constituting regulated prices for electrical energy (capacity) delivered in the retail markets of electrical energy in the territories united in not price zones of the wholesale market of electrical energy and capacity.

5. Item 1 of this resolution becomes effective since July 1, 2016.

Changes which are made to acts of the Government of the Russian Federation concerning enhancement of procedure for pricing in the territories united in not price zones of the wholesale market of electrical energy and capacity

1. The Section VI of standards of disclosure of information by subjects wholesale and the retail markets of electrical energy approved by the order of the Government of the Russian Federation of January 21, 2004 No. 24 "About approval of standards of disclosure of information by subjects wholesale and the retail markets of electrical energy" (The Russian Federation Code, 2004, No. 4, Art. 282; 2010, No. 33, Art. 4431; 2012, No. 23, Art. 3008; 2013, No. 31, Art. 4216; 2014, No. 9, Art. 919; No. 19, Art. 2416; 2015, No. 5, of the Art. 827) to add with Items 23 (1) and 23(2) following contents:

"23(1). The guaranteeing suppliers (the power sales, power supplying organizations) functioning in the territories of not price zones of the wholesale market instead of information provided by subitems "b" - "" of Item 22 of this document, open the following information:

a) value of the weighted regulated price for electrical energy (capacity) used for calculation of final regulated price for the first price category specified in the Section XII of Basic provisions of functioning of the retail markets of electrical energy;

b) values of the components of calculation of the weighted regulated price for electrical energy (capacity) for the first price category specified in the Section XII of Basic provisions of functioning of the retail markets of electrical energy;

c) data on data which belong to the previous settlement periods and are considered in the cases provided by Basic provisions of functioning of the retail markets of electrical energy in case of determination of the weighted regulated price for electrical energy (capacity) concerning consumers (buyers) who chose the first price category for calculations and also about the reasons which caused the necessity of such accounting;

d) values of regulated prices for electrical energy (capacity) delivered in the retail markets of electrical energy in the territories united in not price zones for the first - the sixth price categories;

e) values of the constituting regulated prices for electrical energy (capacity) delivered in the retail markets of electrical energy in the territories united in not price zones for the first - the sixth the price categories used by the guaranteeing supplier (the power sales, power supplying organization) when calculating of the specified regulated prices for settlement period determined according to the procedure, provided by the Section XII of Basic provisions of functioning of the retail markets of electrical energy.

23(2). Information specified in Item 23 (1) this document, is subject to publication on the official sites of the guaranteeing suppliers (the power sales, power supplying organizations) in Internet network monthly, no later than the 17th following settlement.".

In the Section XIV of Rules of the wholesale market of electrical energy and capacity approved by the order of the Government of the Russian Federation of December 27, 2010 No. 1172 "About approval of Rules of the wholesale market of electrical energy and capacity and about introduction of amendments to some acts of the Government of the Russian Federation concerning the organization of functioning of the wholesale market of electrical energy and capacity" (The Russian Federation Code, 2011, No. 14, Art. 1916; 2012, No. 23, Art. 3008):

a) state Item 193 in the following edition:

"193. The organization of commercial infrastructure of the wholesale market concerning group (groups) of points of delivery of each guaranteeing supplier (the power sales, power supplying organization) - the participant of the wholesale market acquiring electrical energy (capacity) in the wholesale market for the purpose of realization in the retail markets in the territories united in not price zones of the wholesale market determines according to these rules, Basic provisions of functioning of the retail markets of electrical energy and the Treaty of Accession to trade system of the wholesale market the following components of regulated prices for electrical energy (capacity) delivered in the retail markets in the territories united in not price zones of the wholesale market (further - final regulated prices) differentiated on price categories:

1) payment for other services which rendering is integral part of process of delivery of electrical energy to consumers;

2) the weighted regulated price for electrical energy in the wholesale market determined by results of calculation of cost of planned hourly production volumes (consumption) of electrical energy and cost of variations of actual production (consumption) of electrical energy from amounts of their planned hourly production (consumption) in the wholesale market concerning settlement period;

3) the weighted regulated price for capacity in the wholesale market determined concerning settlement period;

4) the weighted regulated price for electrical energy (capacity) differentiated on zones of days of settlement period in the wholesale market in zone of days of settlement period;

5) the regulated price for electrical energy differentiated on hours of settlement period in the wholesale market determined by results of calculation of cost of planned hourly production volumes (consumption) of electrical energy and cost of variations of actual production (consumption) of electrical energy from amounts of their planned hourly production (consumption) in the wholesale market concerning hour of settlement period;

6) the regulated price for electrical energy differentiated on hours of settlement period in the wholesale market determined by results of calculation of cost of planned hourly production volumes (consumption) of electrical energy in the wholesale market concerning the amount of electrical energy delivered in hour of settlement period;

7) the regulated price for electrical energy differentiated on hours of settlement period in the wholesale market determined by results of calculation of cost of variations of actual production (consumption) of electrical energy from amounts of their planned hourly production (consumption) concerning amount of excess of the actual consumption over planned consumption in hour of settlement period;

8) the regulated price for electrical energy differentiated on hours of settlement period in the wholesale market determined by results of calculation of cost of variations of actual production (consumption) of electrical energy from amounts of their planned hourly production (consumption) concerning amount of excess of planned consumption over the actual consumption in hour of settlement period;

9) the size of difference of the preliminary requirements and obligations calculated in the wholesale market by results of calculation of cost of variations of actual production (consumption) of electrical energy from amounts of their planned hourly production (consumption) having per unit of electrical energy, determined for settlement period.";

b) add with Items 193 (1) - 193(3) following contents:

"193(1). Measure values, used for calculation of the these rules of the constituting final regulated prices specified in Item 193, are determined and considered in calculation of the constituting final regulated prices the organization of commercial infrastructure of the wholesale market concerning group of points of delivery of the guaranteeing supplier (the power sales, power supplying organization) according to these rules and the Treaty of Accession to trade system of the wholesale market.

If the guaranteeing supplier acquires in the wholesale market electrical energy and capacity on several groups of points of delivery registered in the wholesale market proceeding from borders of zone of its activities as the guaranteeing supplier within one subject of the Russian Federation, then the components of final regulated prices specified in Item 193 of these rules are determined by the organization of commercial infrastructure of the wholesale market for set of the specified groups of points of delivery according to the procedure, defined by the Treaty of Accession to trade system of the wholesale market.

193(2). The organization of commercial infrastructure of the wholesale market according to the procedure, provided by the Treaty of Accession to trade system of the wholesale market, calculates and publishes on the official site on the Internet within 14 days after the end of the corresponding settlement period the following sizes determined concerning group of points of delivery of each guaranteeing supplier (the power sales, power supplying organization) (and if the guaranteeing supplier acquires in the wholesale market electrical energy and capacity on several groups of points of delivery within one subject of the Russian Federation, - on set of the specified groups of points of delivery):

1) the components of final regulated prices specified in Item 193 of these rules;

2) the actual amount of consumption of electrical energy by the guaranteeing supplier (the power sales, power supplying organization) in the wholesale market for the corresponding settlement period;

3) amount of the actual peak consumption of the guaranteeing supplier (the power sales, power supplying organization) in the wholesale market for the corresponding settlement period;

4) the coefficient of payment of capacity for the corresponding zone of days of settlement period determined according to Basic provisions of functioning of the retail markets of electrical energy;

5) the maximum hour of the actual peak load for every working day of settlement period for subjects of the Russian Federation.

193(3). Specified in Item 193 (2) these rules of size are calculated the organization of commercial infrastructure of the wholesale market proceeding from data which she has on the date of calculation.".

b) in Item 73:

the first - the tenth to replace paragraphs with the text of the following content:

"73. Executive bodies of subjects of the Russian Federation in the field of state regulation of rates according to the methodical instructions approved by Federal Antimonopoly Service establish in the form of formulas regulated prices for electrical energy (capacity) delivered in the retail markets of electrical energy in the territories united in not price zones, except for the populations and (or) categories of consumers equated to it (further - final regulated prices), according to the formulas of calculation of final regulated prices provided by the Section XII of Basic provisions of functioning of the retail markets of electrical energy, concerning each guaranteeing supplier (power sales, the power supplying organization) with indication of in numerical expression of the prices (rates) for services in transfer of electrical energy and sales allowances of the guaranteeing suppliers (specific sizes of expenses on realization (sale) of electrical energy of the power sales, power supplying organizations acquiring electrical energy (capacity) in the retail market of electrical energy).

Other components of formulas of determination of final regulated prices, including specific sizes of expenses on realization (sale) of electrical energy of the power sales, power supplying organizations acquiring electrical energy (capacity) in the wholesale market are variable values and are specified in alphabetic expression.

Values of final regulated prices for the corresponding settlement period are calculated the guaranteeing supplier (the power sales, power supplying organization) according to the Section XII of Basic provisions of functioning of the retail markets of electrical energy.";

Executive bodies of subjects of the Russian Federation in the field of state regulation of rates according to the methodical instructions approved by Federal Antimonopoly Service establish in the territories united in not price zones of the wholesale market, the two-part prices (rates) for electrical energy (capacity) developed by electric power producers (capacity) in the retail markets, including rate for 1 kilowatt hour of electrical energy and rate for 1 kilowatt of size of capacity.

Executive bodies of subjects of the Russian Federation in the field of state regulation of rates for the next period of regulation are established in the territories united in not price zones of the wholesale market, in the numerical expression according to the procedure provided by methodical instructions of Federal Antimonopoly Service, the weighted average cost of electrical energy (capacity) acquired by the guaranteeing supplier in the retail markets of electrical energy at regulated prices (rates), falling on all amount of the electrical energy delivered by the guaranteeing supplier according to the approved balance estimation.";

e) recognize Item 77 invalid;

e) ceased to be valid.
