About modification of the Instruction on the organization of forced execution of decisions

According to the Regulations on the Ministry of Justice of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 2, 2014 No. 228, and for the purpose of enhancement of procedure of control of work of the state contractors I order:

1. Bring in the Instruction on the organization of forced execution of decisions approved by the order of the Ministry of Justice of Ukraine of April 02, 2012 No. 512/5, registered in the Ministry of Justice of Ukraine on April 2, 2012 at No. 489/20802 (with changes), the following changes:

in the Section IX:

in the paragraph the second Item 9.2 of the word "In case of Availability of Violations in Actions of the State Contractor" shall be replaced with words "By results of check of enforcement proceeding";

the paragraph one of Item 9.3 to state in the following edition:

"9.3. Heads of bodies of GIS of the highest level have the right according to Articles 84 - 86 Laws to check legality of enforcement proceeding, including complete enforcement proceeding and enforcement proceeding on which the decree on refusal in opening of enforcement proceeding was issued:";

add the Section with new Item of the following content:

"9.9. The heads of bodies of GIS specified in Item 9.3 of this Section in case of control of work of the state contractors and by consideration of addresses of citizens and legal entities on the questions connected with activities of bodies of the public executive service have the right to request the copy of enforcement proceeding or its materials from relevant organ of the public executive service.".
