About employment of the population

This Law determines legal, economic and organizational bases of state policy in the field of employment of the population, is aimed at providing constitutional right of citizens on work, protection against unemployment and establishes the state guarantees in the field of employment.

Chapter I. General provisions

Article 1. The basic concepts used in this Law

this Law the following basic concepts are used:

1) employment – the activities of persons connected with satisfaction personal and public needs, which are not contradicting the legislation of Turkmenistan, bringing in them the income in cash or other form in the form of the salary, contents, payments in kind (further – the salary);

2) unemployment – the social and economic phenomenon in case of which part of able-bodied population cannot find the work suitable for itself according to the physical, psychological, mental abilities which can be applied by them in the course of labor activity;

3) the unemployed – able-bodied person at working-age (for men – 18-62 years, for women – 18-57 years), for the reasons which are not depending on it not having the salary, looking for work and registered in state body (service) of employment (further – employment service) as the unemployed;

4) looking for work – person, for the reasons which are not depending on it not having the salary, looking for work independently or by means of the state and (or) non-state employment service;

5) employment – complex of the organization-legal actions aimed at providing labor employment of the population;

6) self-employed persons are persons, independently, with one or several business partners engaged in activities, revenue-producing, without hiring of workers on permanent basis;

7) quota for creation of workplaces – certain quantity of workplaces (workers) established for employers for the purpose of job security of persons needing the state support;
