About introduction of amendments to some resolutions of the Cabinet of Ministers of the Azerbaijan Republic in connection with creation of the legal entity of the public law of Chamber of control of the financial markets of the Azerbaijan Republic

For the purpose of ensuring execution of Item 7.2 of the Presidential decree of the Azerbaijan Republic "About creation of the legal entity of the public law - Chambers on control of the financial markets of the Azerbaijan Republic" of February 3, 2016 760, of Item 2.2 of the Presidential decree of the Azerbaijan Republic "About approval of the Charter of Chamber of control of the financial markets of the Azerbaijan Republic" of March 10, 2016 No. 828 and Item 1.2 of the Order of the President of the Azerbaijan Republic of March 9, 2016 No. 1872 "About application of the Law of the Azerbaijan Republic "About modification of the Civil code of the Azerbaijan Republic" of March 4, 2016 No. 135-VQD" the Cabinet of Ministers of the Azerbaijan Republic decides No.:

1. In part 6 "Rules of application of excise stamps to excise goods, including import goods", approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of January 8, 2001 No. 10 (Collection of the legislation of the Azerbaijan Republic, 2001, No. 1, Article 59; 2003, No. 6, Article 351; 2007, No. 11, Article 1186; 2009, No. 1, Article 22) shall be replaced with words the words "State Committee on Securities" "The chamber on control of the financial markets".

In the "Rules of state registration of mortgage leaf" approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of February 13, 2006 No. 44 (Collection of the legislation of the Azerbaijan Republic, 2006, No. 2, Article 192, No. 5, Article 461; 2008, No. 1, Article 39; 2009, No. 1, Article 22; 2016, No. 3, Article 614) to make the following changes:

4.1. in Item 1.2 of the word "State Committee on Securities" shall be replaced with words "The chamber on control of the financial markets";

4.2. in the text shall be replaced with words the word "GKTsB" in the corresponding cases of noun "The chamber on control of the financial markets" in the corresponding cases of noun.

5. In "Form of creation of the data represented to Service of financial monitoring under the Central Bank of the Azerbaijan Republic concerning the currency values imported into the Azerbaijan Republic and exported from the Azerbaijan Republic", approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of June 28, 2009 No. 112 (Collection of the legislation of the Azerbaijan Republic, 2009, No. 7, Article 608), to make the following changes:

5.1. in the name and part 1 of the word "in Service of financial monitoring under the Central bank" shall be replaced with words "in Chamber on control of the financial markets";

5.2. in "The form of creation of the data represented to Service of financial monitoring under the Central Bank of the Azerbaijan Republic concerning approved by this resolution of the currency values imported into the Azerbaijan Republic and exported from the Azerbaijan Republic":

5.2.1. in parts 1 and 2 of the word "in Service of financial monitoring under the Central bank" shall be replaced with words "in Chamber on control of the financial markets";

5.2.2. in part 2-6 of the word "Service of Financial Monitoring" in the corresponding cases of noun shall be replaced with words "The chamber on control of the financial markets" in the corresponding cases of noun;

6.1. regarding 3 words "Service of Financial Monitoring under the Central Bank of the Azerbaijan Republic (Further — Service of Financial Monitoring)" shall be replaced with words "The chamber on control of the financial markets of the Azerbaijan Republic (further - Chamber on control of the financial markets)";

"Approval procedure of the General list of physical persons or legal entities to which within counteraction to financing of terrorism sanctions according to the legislation and international agreements of the Azerbaijan Republic, and also resolutions of the Security Council of the United Nations are applied", No. 124 approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of June 25, 2010 (Collection of the legislation of the Azerbaijan Republic, 2010, No. 6, Article 568), to make the following change:

7.1. in item 4 of part 1 of the word "Service of Financial Monitoring under the Central Bank" shall be replaced with words "The chamber on control of the financial markets";

In "The rule regulating external or internal borrowings of the legal entities who are receiving financial aid or grants of investment orientation from the government budget, and also having obligations to the government budget including the debts received under the state guarantee", approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of July 28, 2010 No. 143 (Collection of the legislation of the Azerbaijan Republic, 2010, No. 7, Article 708; 2014, No. 2, Article 201; 2016, No. 5, Article 955) to make the following changes:

8.1. regarding 2 words "in the State committee on securities" shall be replaced with words "in Chamber on control of the financial markets";

8.2. in "The rules approved by this resolution regulating external or internal borrowings of the legal entities who are receiving financial aid or grants of investment orientation from the government budget, and also having obligations to the government budget including the debts received under the state guarantee":

8.2.1. in subitem 4.2.5 of the word of Central bank shall be replaced with words "Chambers on control of the financial markets";

8.2.2. at the end of part 5 to add with "Note" of the following content:

"Note. Changes can be made to this Procedure according to the Item 2.6-1 "Regulations on Procedure for Preparation and Adoption of Regulatory Legal Acts of Executive Bodies", No. 772 approved by the Presidential decree of the Azerbaijan Republic of August 24, 2002.".

9. In the "Rules of the organization and carrying out sports totalizators" approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of August 20, 2010 No. 153 (Collection of the legislation of the Azerbaijan Republic, 2010, No. 8, Article 762; 2012, No. 5, Article 494; 2013, No. 6, Article 752; 2016, No. 6, Article 1187) to make the following changes:

9.1. in Item 13.2 of the word "in the State committee on securities" shall be replaced with words "in Chamber on control of the financial markets";

9.2. in Item 13.3 of the word "State Committee on Securities" shall be replaced with words "The chamber on control of the financial markets".

10. In "The rule of the organization and holding games dzhydyr-chance (totalizator)", approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of August 12, 2011 No. 134 (Collection of the legislation of the Azerbaijan Republic, 2011, No. 8, Article 780; 2014, No. 7, Article 948; 2016, No. 6, Article 1188) to make the following changes:

10.1. in Item 6.2 of the word "in the State committee on securities" shall be replaced with words "in Chamber on control of the financial markets";

10.2. in Item 6.3 of the word "State Committee on Securities" shall be replaced with words "The chamber on control of the financial markets".

11. In the resolution of the Cabinet of Ministers of the Azerbaijan Republic "About enhancement of the mechanism of the organization, generalization and distribution of statistics of external debt and the international investments according to international standards" of April 22, 2015 No. 118 (Collection of the legislation of the Azerbaijan Republic, 2015, No. 4, Article 481) to make the following changes:

11.1. regarding 1 after the word of "Bank" to add with the words "Chamber on Control of the Financial Markets of the Azerbaijan Republic";

11.2. in items 4. 4.6 and 10.6 Contractors columns of the appendix 1 approved by this resolution - "Distribution of obligations between the Central bank of the Azerbaijan Republic, the State oil fund of the Azerbaijan Republic and the central executive bodies in connection with enhancement of the mechanism of the organization, generalization and distribution of statistics of total external debt of the country and the international investments according to the international methodology of the word "State Committee on Securities" shall be replaced with words 3, "The chamber on control of the financial markets";

11.3. in parts 9 and 10 of the Sender of Data column of the appendix 3 approved by this resolution - "The table of inter-agency exchange of data on the organization, generalization and distribution of statistics of total external debt and the international investments" shall be replaced with words the words "State Committee on Securities" "The chamber on control of the financial markets".

In the "Procedure for preparation and adoption of acts of the Central bank of the Azerbaijan Republic of normative nature" approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of November 11, 2011 No. 184 (Collection of the legislation of the Azerbaijan Republic, 2011, No. 11, Article 1066), to make the following changes:

12.1. cancel Item 2.4;

12.2. after Item 4.2 to add with "Note" of the following content:

"Note. Changes can be made to this Procedure according to the Item 2.6-1 "Regulations on Procedure for Preparation and Adoption of Regulatory Legal Acts of Executive Bodies", No. 772 approved by the Presidential decree of the Azerbaijan Republic of August 24, 2002.".
