About modification and amendments in some legal acts

This law creates the necessary legal base for application of provisions of the Directive 2008/122/EC of the European Parliament and Council of January 14, 2009 about consumer protection of rather some aspects of the timeshare, long-term tourist products, agreements of the resale and exchange published in the Official magazine of the European Union by L33 of February 3, 2009.

Art. I. – In the Civil code of the Republic of Moldova No. 1107-XV of June 6, 2002 (Official monitor of the Republic of Moldova, 2002, Art. No. 82-86, 661), with subsequent changes, to make the following changes and additions:

1. To add Chapter I of the Section I of the book of the first with Article 2-1 of the following content:

"Article 2-1. Consumer and professional

(1) Consumer is any physical person acting within the civil legal relationship mainly for the purpose of which are not connected with business or professional activity. The physical person does not act as the consumer if other party of civil legal relationship does not act as professional.

(2) Professional is any physical person or the legal entity of public or private law acting within the civil legal relationship for the purpose of connected with business or professional activity at least person and did not pursue revenue generating purpose from these activities.

(3) Person who in civil legal relationship corresponds as part provisions (1) and to part provisions (2), it is considered the consumer if recognition him in this quality provides it certain legal protection, in other cases it is considered professional.".

2. To add Chapter VII of the Section II of the book of third with part 3 following of content:

"Part 3. The right of withdrawal of agreements on some tourist products and agreements of mediation in them

Article 752-1. The right of withdrawal of agreements on some tourist products and agreements of mediation in them

(1) According to this code or other law the consumer has the right to withdraw:

a) agreement of the timeshare;
