About modification of some legal acts of Ukraine concerning enhancement of access to justice of persons containing in organizations of pre-trial detention and execution of punishments

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Criminal Procedure Code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2013, Art. No. No. 9-13, 88):

1) in Article 537:

add part one with Items 13-1 and 13-2 of the following content:

"13-1) about contest of other decisions, actions or failure to act of administration of organization of execution of punishments;

13-2) about application of disciplinary measures to persons imprisoned in the form of transfer of the chamber type condemned to the room (solitary confinement)";

add with part two of the following content:

"2. Appeal of decisions, actions or failure to act of administration of organization of pre-trial detention is performed according to the procedure, established for Item of 131 part one of this Article";

2) in Article 539:

in part two:

" (except the petition for the termination of forced treatment which moves in local court within which territorial jurisdiction there is organization or institution in which the convict is on treatment)" to add Item 1 after words with figures "13-1, 14";

"11, 13" to add Item 2 after figures with figures "13-2";

after part three to add with new part of the following content:

"4. The petition (idea) of application of disciplinary measures to persons imprisoned in the form of transfer of the chamber type condemned to the room (solitary confinement) and about forced feeding of the convict are considered within 24 hours from the moment of receipt of the corresponding petition (submission) to court by the judge solely".

With respect thereto the fourth - the seventh to consider parts respectively parts five - the eighth;

add with part nine of the following content:

"9. Hearing of cases on the questions determined in Item 13-1 of part one of article 537 of this Code is performed according to the procedure of administrative legal proceedings".
