About modification of some legal acts of Ukraine of rather legal destiny of the parcels of land which owners died

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. The Item "in" of part five of Article 83 of the Land code of Ukraine (2002, 27) to state sheets of the Verkhovna Rada of Ukraine to Art. No. 3-4, in the following edition:

"c) inheritance acceptance or transition to their property of the parcels of land recognized by court escheated inheritance".

2. In the Civil code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2003, Art. No. No. 40-44, 356):

1) in Article 1277:

in part one:

after the words "in the place of opening of inheritance" to add with the words "and if real estate-on its location is part of inheritance";

add with paragraphs the second - the fourth the following content:

"If on the real estate unit at the time of opening of inheritance there is personal estate which is part of inheritance, such personal estate carries over territorial community to which real estate is transferred.

The application for recognition of inheritance escheated can be also submitted by the creditor of the testator and if the parcels of land of agricultural purpose - owners or users of the adjacent parcels of land are part of inheritance. In that case the court involves in consideration of the case local government bodies in the place of opening of inheritance and/or on the location of the real estate which is part of inheritance.

Persons who have the right or shall submit the application for recognition of inheritance escheated, have right to be informed from the Heritable register about the opened heritable case and the granted certificate on the right to inheritance";
