About modification and amendments in the Law of the Republic of Belarus "About guarantees on social protection of orphan children, children without parental support, and also persons from among orphan children and children without parental support"

Article 1. Bring in the Law of the Republic of Belarus of December 21, 2005 "About guarantees on social protection of orphan children, children without parental support, and also persons from among orphan children and children without parental support" (The national register of legal acts of the Republic of Belarus, 2006, No. 2, 2/1170; 2007, No. 305, 2/1402; 2008, No. 14, 2/1412; 2010, No. 287, 2/1744; 2012, No. 10, 2/1903; National legal Internet portal of the Republic of Belarus, 11.01. 2014, 2/2104) following changes and amendment:

1. To state Item 3 of Article 9 in the following edition:

"3. Expenses on payment for use of premises, maintenance, maintenance of the elevator, sanitary content of auxiliary rooms of the apartment house, payment for utilities (also cold water supply, water disposal (sewerage), gazo-, electro-and heat supply, the address with solid utility waste, supply with the liquefied hydrocarbon gas from individual balloon or reservoir installations is hotter), for compensation to the organizations performing operation of housing stock and (or) providing housing and communal services, expenses on the electric power (further - expense recovery for the electric power) consumed on the lighting of auxiliary rooms and operation of the equipment, including elevators, on fuel payment (living in houses without central heating) connected with content of orphan children, the children without parental support who are in the orphanages of family type (located in premises belonging to citizens on the property right or occupied by them according to the employment contract of premises of the state housing stock, according to the employment contract of premises of private housing stock of legal entities), tutorial families and foster homes, are subject to compensation to citizens on whose education they are, at the expense of means of local budgets.

These expenses are determined proceeding from established by the legislation of payment for use of premises, maintenance, maintenance of the elevator, sanitary content of auxiliary rooms of the apartment house, expense recovery for the electric power consumed on lighting of auxiliary rooms and operation of the equipment, including elevators, rates (prices) of utilities and also from the actual consumption by the specified children of these services estimated based on the regulations (standard rates) of their consumption or indications of individual or group metering devices established by local executive and administrative organs, but not above the called regulations (standard rates), and concerning fuel - proceeding from its actual consumption by the specified children estimated based on the regulations established by the legislation for sale to the population. At the same time compensation of the amounts paid for use of premises, maintenance, maintenance of the elevator, sanitary content of auxiliary rooms of the apartment house, expense recovery for the electric power consumed on lighting of auxiliary rooms and operation of the equipment, except for elevators and also for the consumed heat energy is made within 20 square meters of total area of premises on one child who is in the orphanage of family type (located in the premises belonging to citizens on the property right or occupied by them according to the employment contract of premises of the state housing stock, according to the employment contract of premises of private housing stock of legal entities), tutorial family or foster home. Compensation of the amounts paid for expense recovery for the electric power consumed for operation of elevators is made proceeding from the number of the children who are in orphanage of family type, tutorial family or foster home.

Expenses on payment for use of room phone (except long-distance and international calls), household services (services of laundries, hairdresser's, on repair of footwear), connected with content of orphan children, the children without parental support who are in orphanages of family type, tutorial families and foster homes are subject to compensation to citizens on whose education they are, at the expense of means of local budgets proceeding from the regulations established by the Government of the Republic of Belarus.".

2. To state Item 5 of Article 10 in the following edition:

"5. By provision of the certificate of employment (registration in committee on work, employment and social protection of the Minsk city executive committee, management (department) of work, employment and social protection of city, district executive committee) or about establishment of group of disability and contraindications to work within twelve months after assignment the set of clothes, footwear, soft stock and equipment is issued to orphan children, children without parental support, and also persons from among orphan children and children without parental support deducted from the relevant organizations of education in connection with education or for other reasons, and also the money allowance on the established regulations is paid.

For the persons who are getting in public institutions educations of the Republic of Belarus professional, secondary vocational or higher education in day form of education and lost during education the status of person from among orphan children and children without parental support in connection with achievement of age of 23 years, in case of expel from the relevant organizations of education in connection with education or for other reasons and in case of observance of the conditions specified in part one of this Item the right to set of clothes, footwear, soft stock and equipment, and also money allowance on the established regulations remains.

At the request of persons specified in parts one and the second this Item instead of set of clothes, footwear, soft stock and the equipment the monetary compensation on the established regulations is paid.".

3. In Article 12:

in Item 1:

the second to state part in the following edition:

"Premises of social use of the state housing stock are provided to orphan children and children without parental support on whom the decision on emancipation is made or which married, and also to persons from among orphan children and children without parental support within five years from decision date about emancipation or marriages, after achievement of age of majority by them or at will within one year after the termination of institutions of higher education.";

after part two to add Item with part of the following content:

"Before realization of the rights established by part one of this Item, to orphan children and children without parental support on whom the decision on emancipation is made or which married, and also to persons from among orphan children and children without parental support premises in hostels according to the procedure, established by the legislation are provided.";

in word part four "part one" and "provisions of the first workplace by it" to replace respectively with words "parts one and third" and "works (service), provided on distribution, job placement according to the agreement on target training of the specialist (the worker, the employee)";

Article 2. To Council of Ministers of the Republic of Belarus in three-months time:

provide reduction of acts of the legislation in compliance with this Law;

take other measures for realization of provisions of this Law.

Article 3. This Law becomes effective after its official publication.
