About introduction of amendments to the Law on the Government No. 64-XII of May 31, 1990

The Parliament adopts this organic law.

In the Law on the Government No. 64-XII of May 31, 1990 (repeated publication: The official monitor of the Republic of Moldova, 2002, Art. No. 131-133, 1018), with subsequent changes to make the following changes:

1. State Article 7-1 in the following edition:

"Article 7-1. Functions and limits of competence of the Government which powers are stopped

In case of expression of non-confidence vote by Parliament, resignation of the Prime Minister or elections of new Parliament the Government which powers are stopped before bringing of the oath by members of the new Government adopts only the acts having individual and normative character necessary for management of public affairs.

The government which powers are stopped has no right:

1) to approve and represent to Parliament drafts of the laws and drafts of program documents;

2) to accept ordinances and program documents;

3) to draw the conclusions on legislative initiatives;

4) to appoint, offer for position assignment or to dismiss persons who are taking up responsible state positions or the leading state positions (including the highest), except as specified objective impossibility of performance person of the official functions;

5) to assume contractual commitments sine die or for the term of more than one year or the obligation which cost is disproportionate to the expenses necessary for management of the current public affairs or for management of emergency situations;

6) to sign the international agreements from which there are monetary commitments for the Republic of Moldova.

Before bringing of the oath by members of the new Government the acting as the Prime Minister has no right to offer the President of the Republic of Moldova staff movements in the Government.".
