About introduction of amendments to the Tax Code of Ukraine concerning refining of separate regulations on the taxation of the non-profitable organizations

I. Bring in the Tax code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2011, Art. No. 13-17, 112) the following changes:

1. In Item 133.4 of Article 133:

The paragraph third subitem 133.4.1 to add 1) with the offer of the following content: "For the purposes of this paragraph it is impossible to consider distribution of the gained income (profit) financing of the expenses determined by subitem 133.4.2 of this Item";

Subitem 133.4.2 to add 2) with the paragraph the second the following content:

"The income of the non-profitable religious organizations is used also for implementation of the non-commercial (charitable) activities provided by the law for the religious organizations including provision of the humanitarian assistance, implementation of charity, mercy";

"Constituent documents" shall be replaced with words 3) in subitem 133.4.4 of the word "subitem 133.4.2 of this Item".

2. To add Item 35 of subsection 4 of the Section XX "Transitional provisions" with the paragraph third the following content:

"Temporarily, till January 1, 2018, there cannot be the basis for exception of the non-profitable religious organizations of the Register of non-profitable organizations and the organizations failure to carry out by such religious organizations of the requirements to constituent documents determined by subitem 133.4.1 of Item 133.4 of Article 133 of this Code".

II. Final provisions

1. This Law becomes effective from the date of, its publication following behind day.

2. To the Cabinet of Ministers of Ukraine within three months from the date of entry into force of this Law:

adopt the regulatory legal acts necessary for implementation of this Law;

provide review and reduction by the ministries and other central executive bodies of their regulatory legal acts in compliance with this Law.
